<br /> . <br /> 7.2 The Contractor shall provide scale receipts of the recyclable materials collected in .1 <br /> each district and a statement of verification that the scale receipts reflect the I <br /> recyclable materials only collected in each particular district. Receipts are due by - <br /> the third day of the month following collection. <br /> 8. Insurance I <br /> 8.1 Prior to commencement of this Agreement, the Contractor shall furnish the City . <br /> with certificates of insurance for comprehensive general liability, automobile <br /> liability and property damage insurance, to meet all City insurance requirements. I <br /> The policy shall require the Insurance Company to notifY the City in writing of <br /> any cancellation in coverage, at least ten (10) days prior to cancellation. Any <br /> losses to persons or property through this project shall be the responsibility of the I <br /> Contractor. The Contractor agrees to indemnifY the City from any and all liability <br /> or loss arising in any way out ofthe performance of this contract. <br /> 9. Relationship of Parties I <br /> 9.1 The parties intend that an independent Contractor-employee relationship will be I <br /> created by the contract. The City is interested only in the results to be achieved, <br /> and the conduct and control of the City for any purpose, and the employees of the -. <br /> Contractor are not entitled to any of the benefits that the City provides for its <br /> employees. <br /> 10. T erminationlExtension I <br /> 10.1 If, in the City's opinion, the Contractor fails to carry out the services diligently <br /> and on schedule, the City shall have the right to terminate the agreement. Prior to I <br /> termination, the City will give written notice of intent to terminate. This intent to <br /> terminate shall be served upon the Contractor thirty (30) days prior to termination. I <br /> 10.2 If, at any time during the term of this contract significant changes to the program <br /> occur (i.e.: use of recycling bins, frequency of pick up, addition ifnew collectible I <br /> materials, etc...), the City and the Contractor mutually agree that the contract will <br /> open for negotiation and/or unless negotiated differently, will terminate at the end <br /> of that calendar year. I <br /> 10.3 If, at the end of the term of this contract, the City and the Contractor mutually <br /> agree on an extension of this contract, this agreement will remain in effect until I <br /> otherwise renegotiated. <br /> I <br /> -. <br /> . <br />
