The Planning Commission reviewed this application at their July 10, 2024 meeting and have <br />offered the following findings of fact for your consideration: <br />1. The property located at 3535 Pine Tree Drive is designated for Community Mixed Use on <br />the 2040 Comprehensive Plan. <br />2. New building construction or site modification identified requires the submittal of a Site <br />Plan Review application prior to construction. <br />3. For proposals for new construction, redevelopment of a site, and significant <br />modifications to existing sites a PUD is required. <br />4. The PUD process allows for flexibility within the City's regulations through a negotiated <br />process with an Applicant. <br />5. The Applicant has proposed a Master and Final Planned Unit Development for the <br />development of a 41,000 square foot Headquarters Fire Station facility on the Subject <br />Property. <br />6. The Subject Property is zoned B-2 General Business District which requires a <br />Conditional Use Permit for Public Use. <br />7. The Cities of Arden Hills, North Oaks, and Shoreview contract with the Lake Johanna <br />Fire Department to provide emergency response services for Fire and EMS calls to the <br />public. The City refers to the Lake Johanna Fire Department in the 2040 Comprehensive <br />Plan under Chapter 13, Public Facilities, Services, and Infrastructure <br />8. The Master and Final Planned Unit Development generally conforms to the requirements <br />of the City Zoning Code and design standards. <br />9. Where the plan is not in conformance with the City Code, flexibility has been requested <br />by the Applicant. <br />10. Flexibility through the PUD process has been requested in the following areas: building <br />positioning, transparency, and landscaping. <br />11. A public hearing for a Master Planned Unit Development, Final Planned Unit <br />Development, and Conditional Use Permit request is required before the request can be <br />brought before the City Council. <br />12. The Planning Commission held the required public hearing on July 10, 2024. <br />Options and Motion Language <br />The Planning Commission reviewed this application at their July 10, 2024 meeting. At that time <br />they recommended approval with conditions of the Lake Johanna Fire Department application for <br />a Master Planned Unit Development, Final Planned Unit Development, Conditional Use Permit, <br />and Site Plan Review by a 6-0 vote. The Planning Commission added Conditions 18, 19, and 20 <br />to address the comments of the PW/Engineering Division, tree mitigation plans, and Public <br />Use/Park Dedication fees for the plat. The following are motion language options for the City <br />Council to consider. <br />• Approval with Conditions: Motion to approve Resolution 2024-037 and Planning Case 24-009 <br />for a Master Planned Unit Development, Final Planned Unit Development, Conditional Use <br />Permit, and Site Plan Review at 3535 Pine Tree Drive, based on the findings of fact and the <br />submitted plans, as amended by the conditions in the July 22, 2024 Report to the City Council: <br />1. The project shall be completed in accordance with the submitted plans as amended by the <br />conditions of approval. Any significant changes to these plans, as determined by the <br />Community Development Director, shall require review and approval by the Planning <br />Commission and City Council. <br />Page 3 of 5 <br />
