Page 13 of 15 <br /> <br />Public Works Director/City Engineer <br />The Public Works Director/City Engineer is currently reviewing the plans. Draft conditions at a <br />minimum have been included on standard PW/Engineering permit requirements. <br /> <br />Findings of Fact <br /> <br />The Planning Commission must make a finding as to whether or not the proposed application <br />would adversely affect the surrounding neighborhood or the community as a whole based on the <br />aforementioned factors. Staff offers the following findings for consideration: <br /> <br />1. The property located at 3535 Pine Tree Drive is designated for Community Mixed Use on <br />the 2040 Comprehensive Plan. <br />2. New building construction or site modification identified requires the submittal of a Site <br />Plan Review application prior to construction. <br />3. For proposals for new construction, redevelopment of a site, and significant <br />modifications to existing sites a PUD is required. <br />4. The PUD process allows for flexibility within the City’s regulations through a negotiated <br />process with an Applicant. <br />5. The Applicant has proposed a Master and Final Planned Unit Development for the <br />development of a 41,000 square foot Headquarters Fire Station facility on the Subject <br />Property. <br />6. The Subject Property is zoned B-2 General Business District which requires a <br />Conditional Use Permit for Public Use. <br />7. The Cities of Arden Hills, North Oaks, and Shoreview contract with the Lake Johanna <br />Fire Department to provide emergency response services for Fire and EMS calls to the <br />public. The City refers to the Lake Johanna Fire Department in the 2040 Comprehensive <br />Plan under Chapter 13, Public Facilities, Services, and Infrastructure <br />8. The Master and Final Planned Unit Development generally conforms to the requirements <br />of the City Zoning Code and design standards. <br />9. Where the plan is not in conformance with the City Code, flexibility has been requested <br />by the Applicant. <br />10. Flexibility through the PUD process has been requested in the following areas: building <br />positioning and landscaping. <br />11. A public hearing for a Master Planned Unit Development, Final Planned Unit <br />Development, and Conditional Use Permit request is required before the request can be <br />brought before the City Council. <br /> <br />Options and Motion Language <br /> <br />Staff has provided the following options and motion language for this case. The Planning <br />Commission should consider providing additional findings of fact as part of the motion to support <br />their recommendation for approval or denial. <br /> <br /> Recommend Approval with Conditions: Motion to recommend approval of Planning Case 24- <br />009 for a Master Planned Unit Development, Final Planned Unit Development, Conditional <br />Use Permit, and Site Plan Review at 3535 Pine Tree Drive, based on the findings of fact and <br />the submitted plans, as amended by the conditions in the July 10, 2024 Report to the Planning <br />Commission: <br /> <br />1.
