At this stage, the City Council is being asked to evaluate the proposed preliminary plat and the <br />proposed rezoning of the newly created lot to align with the future land use designation for this <br />property. A subsequent land use application will be submitted for the final plat as well as the <br />proposed development plans for this property would be brought forward at a future meeting for <br />review. The Comprehensive Plan is the planning tool that guides the future development of land <br />irrespective of a specific project and the City is required to amend the Zoning Code to comply with <br />the Comprehensive Plan. <br />2. Comprehensive Plan and Zoning Code Requirements <br />Minnesota state law requires that all communities within the Minneapolis -St. Paul metropolitan <br />area update their Comprehensive Plans every ten years. The purpose of the Comprehensive Plan <br />is to establish the policies that guide the future physical and community development of Arden <br />Hills. It is also a reference document for the Planning Commission and City Council when <br />evaluating private development projects. <br />Based on the future land uses, the City can plan for improvements, anticipate infrastructure needs, <br />and create appropriate land use regulations. The City's Zoning Code identifies specific zoning <br />districts through which the land uses and goals in the Comprehensive Plan can be implemented. <br />The zoning cannot conflict with the future land use designation. When there is a conflict between <br />the Comprehensive Plan and the Zoning Code, the City is required to amend the Zoning Code to <br />comply with the Comprehensive Plan. <br />Approvals <br />The City Council is asked to determine if a Preliminary Plat and Rezoning request should be <br />approved to split the Subject Property located at 1700 West Highway 96 into two separate parcels <br />and to amend the zoning on the proposed newly created 10.74-acre northwest parcel. The <br />evaluation of the proposal should be based on the requirements of Chapter 11 — Subdivisions and <br />Chapter 13 — Zoning Code and the District Provisions in Section 1320. <br />The Preliminary Plat is the first step toward the Final Plat, which is required for the development <br />plans for this property. The Final Plat will be brought forward in a later land use application for <br />review and evaluated according to the Subdivisions ordinance. <br />Page 3 of 9 <br />
