<br />, <br /> <br />"'" <br /> <br />. <br /> <br />, <br /> <br />~. <br /> <br />. <br /> <br />~ <br /> <br />~~ <br />{'"L--/3 <br /> <br />"i4AJJ-r..-/ / f /9 I J d <br />-r- /Y'-I/ <br /> <br />CONSENT AND AGREEMENT <br /> <br />WHEREAS the Village of Arden Hills, a municipal corporation, <br /> <br />hereinafter called "Village", is the fee owner of, and is constructing a <br /> <br />sanitary sewer improvement over the North 50 feet of the West 280 feet of <br /> <br />the SE l/4 of the SW l/4 of Section 22, Township 30, Range 23, and <br /> <br />WHEREAS Northern States Power Corrl'pany is the owner of and is <br /> <br />occupying an easement for electric transmission line purposes over the North <br /> <br />50 feet of the West 280 feet of the SE 1/4 of the SW l/4 of Section 22, Township <br />30, Range 23. Said easement is recorded as Document No. 1303817 in Book 316 <br /> <br />of Misc., page 429, Register of Deeds, Ramsey County, Minnesota; and <br /> <br />WHEREAS it is undetermined whether or to what extent the sewer <br /> <br />construction by the Village will affect the easement rights of Northern States <br /> <br />Power Company, above described. <br /> <br />NOW, THEREFORE, in consideration of the covenants and agreements <br /> <br />of the parties hereinafter stated: <br /> <br />1. NSP hereby consents to the construction and maintenance by the <br /> <br />Village, its successors and assigns, of said sanitary sewer easement over <br /> <br />and across the above described easement owned and occupied by NSP, and further <br /> <br />consents that NSP shall not be entitled to any damages in lieu of condeItllllition <br /> <br />as a result of this construction and occupancy of said property. <br /> <br />2. In consideration of the consent of NSP, above stated, the <br /> <br />Village covenants and agrees that it will reimburse NSP for the actual cost <br /> <br />and expense of any alteration, relocation, protection or supervision of its electric <br />
