AGENDA ITEM - 3B <br />-ARVE_-HILLS <br />MEMORANDUM <br />DATE: November 25, 2024 <br />TO: Honorable Mayor and City Councilmembers <br />Jessica Jagoe, Interim City Administrator <br />FROM: Julie Hanson, Assistant to the City Administrator/City Clerk <br />SUBJECT: Draft Ordinance Amending Chapter 3 Related to Adult Cannabis Registration <br />Budgeted Amount: Actual Amount: Funding Source: <br />Council Should Consider <br />Council should consider providing feedback regarding the attached draft ordinance amending Chapter <br />3 and establishing a City registration for adult cannabis sales. <br />Backaround/Discussion <br />At the October 14 work session, Council discussed zoning and reviewed an initial draft ordinance <br />amendment of Chapter 13 related to adult use cannabis businesses in the city. Following Council <br />direction, staff made the requested changes to the draft, which was then brought forward to the <br />Planning Commission at its November 6 meeting. Please note the Council will be considering the <br />proposed draft ordinance related to adult use cannabis and zoning at tonight's regular Council <br />meeting (agenda items IOB (Public Hearing) and I I (New Business)). <br />Chapter 342.22 of Minnesota law requires local governments to register a cannabis business <br />following verification of a valid license or license preapproval by the Office of Cannabis <br />Management (OCM), that is in compliance with Chapter 342 as well as local ordinances, is current <br />on all property taxes and assessment for the proposed retail location (if applicable), and that has paid <br />the registration and renewal fees to the local government for such. <br />Staff has worked with the City Attorney regarding the attached proposed draft ordinance related to <br />amending Chapter 3 to include the addition of a new section addressing the registration of adult use <br />cannabis retail sales as well as addressing cannabis events. <br />Staff requests that Council provide feedback regarding the attached draft ordinance. Please note <br />associated fees for the initial registration, registration renewal, and a penalty violation were presented <br />to Council under item 3A (proposed draft 2025 Fee Schedule). <br />Attachments <br />Attachment A: Draft Ordinance 2024-OXX Amending Chapter 3 <br />Page 1 of 1 <br />
