The property is zoned B-2, General Business <br />Zoning District and is guided as Community Mixed Use. <br />2. CONDITIONS OF APPROVAL. <br />A. The City hereby approves the Development on condition that the Developer enter <br />into this Agreement; obtain a Conditional Use Permit as required by City Code; and record the <br />CUP and this Agreement, together with any appropriate consents prior to the City's issuance of a <br />building permit for, or development of, the Subject Property, in the Office of the Ramsey County <br />Recorder and Ramsey County Registrar of Titles, as applicable, within sixty (60) days after the <br />City Council approves the Agreement. <br />B. The City hereby approves the Development on condition that the Developer <br />Implement the conditions listed in Resolution No. 2024-037 Approving a Conditional Use Permit <br />dated July 22, 2024. <br />C. The City hereby grants approval to the Development as adopted on July 22, 2024, <br />by Resolution No. 2024-037, and compliance with the terms and conditions of this Agreement and <br />all other City requirements which are in effect. The specific conditions, requirements, and terms <br />of approval are as set forth in City Resolution 2024-037, adopted by the Arden Hills City Council <br />on the 22" d day of July, 2024. <br />3. RIGHT TO PROCEED. Within the Subject Property, the Developer may not <br />grade or otherwise disturb the earth, remove trees, construct sewer lines, water lines, streets, <br />utilities, public or private improvements, or any buildings until all the following conditions have <br />been satisfied: 1) this Agreement has been fully executed by both parties and filed with the City <br />Clerk, 2) the necessary security has been received by the City, 3) the CUP and this Agreement <br />2 <br />
