for design changes and contract administration between the Developer and the Developer's <br />contractor. The Developer or Developer's engineer shall schedule a pre -construction meeting at a <br />mutually agreeable time at Arden Hills City Hall, or location designated by City staff, with all <br />parties concerned, including City staff, to review the program for the construction work. If <br />applicable, the Developer will install sidewalks just prior to the installation of the final lift of <br />asphalt. <br />9. OWNERSHIP OF IMPROVEMENTS. Upon completion of the work and <br />construction required by this Agreement, the sidewalk and related Improvements lying within <br />public easements shall become City property without further notice or action. Upon completion <br />of the public improvements, the City shall inspect the public improvements and notify Developer <br />if any of the improvements do not conform to the requirements of this Agreement. Upon <br />compliance with this Agreement with respect to public improvements, the City shall give formal <br />notice of acceptance to Developer and thereafter Developer shall have no responsibility with <br />respect to the maintenance of the public improvements, except during any warranty periods. <br />10. WARRANTY. The Developer warrants the sidewalk and related public <br />improvements required to be constructed by it pursuant to this Agreement for a period of twenty- <br />four (24) months from the date of acceptance by the City against poor material and faulty <br />workmanship. Any trees and shrubs that are public improvements shall be warranted to be alive, <br />of good quality, and disease free for twenty-four (24) months after planting. Any replacements <br />shall be warranted for twenty-four (24) months from the time of planting. <br />11. IRON MONUMENTS. If any survey/plat monuments are disturbed during <br />construction of the Development, the Developer's surveyor shall submit a written notice to the <br />City certifying that such monuments have been reinstalled. <br />5 <br />
