Planning Case No. 03-07: Guidant Site Plan Review Building <br />Addition I <br /> <br />Mr. Hellegers explained the applicant was requesting approval of a Site Plan <br />Review for Building Addition "I" at County Road E2 and Cleveland Avenue. He <br />stated the Planning Commission recommended approval of the site plan review <br />with seven conditions as noted in staffs report. <br /> <br />. <br /> <br />MOTION: Councilmember Holden moved and Councilmember Larson <br />seconded a motion to approve Planning Case No. 03-07: <br />Guidant Corporation, 4100 North Hamline Avenue Site Plan <br />Review Building Addition "I" with the conditions as noted in <br />staffs March 13,2003 report. The motion carried unanimously <br />(5-0). <br /> <br />4. Tramm Builders: PUD, Permit and Development Agreement <br /> <br />Mr. Hellegers stated the applicant was requesting approval of a Planned Unit <br />Development Permit and the Development Agreement. He explained Mr. Tramm <br />had decided that a new Registered Land Survey would be more appropriate for his <br />building situation than platting. The City Attorney informed Mr. Tramm that his <br />opinion was that the proposed development would be a subdivision of property, <br />and that the development would be subject to the public use/park dedication fees. <br />Staff has met with Mr. Tramm and negotiated a 6.5% public use dedication fee. <br />Mitigating circumstances include that Mr. Tramm would be providing a trail and <br />sidewalk for the north and west sides of the property and he would be granting the <br />City an easement for the lift station. In addition, given the neighborhood business <br />scale of the development, it seemed reasonable to have a public use dedication fee, <br />which is somewhere between a residential fee and that of a larger commercial <br />development. He noted staff was comfortable with the 6.5% public use dedication <br />fee, given the mitigating circumstances. <br /> <br />. <br /> <br />Mr. Tramm thanked the Council for their consideration. <br />
