<br />2 <br />23, 2024 and recorded ___________, 2025 as Ramsey County Document No. <br />_________________ (“Development Agreement/PUD”). <br />B. The Developer is the fee owner of the property legally described on the attached Exhibit <br />A (“Property”). <br />C. Developer has requested an amendment to the Development Agreement/PUD regarding <br />exterior finishes and materials and has requested flexibility for such. <br />D. Pursuant to Paragraph 22D of the Development Agreement/PUD, any amendment to the <br />Development Agreement/PUD must be in writing, signed by the parties and approved by <br />written resolution of the City Council. <br />E. The City Council has reviewed and approve the proposed application submitted by the <br />Developer. <br />NOW THEREFORE, in consideration of the premises and the mutual obligations of the parties <br />hereto, the parties agree as follows: <br />1. The City hereby grants approval to the Developer’s request for an amendment to the <br />Development Agreement/PUD subject to the following conditions: <br />• The Conditions of Approval in Paragraph 2B be modified to reference the <br />conditions listed in Resolution No. 2024-050 Approving a Planned Unit <br />Development Amendment dated October 28, 2024; and <br /> <br />• The Conditions of Approval in Paragraph 2C be modified to reference the <br />amendments included in Resolution No. 2024-050 Approving a Planned <br />Unit Development Amendment dated October 28, 2024. <br /> <br />2. The City hereby approves the additional Development Agreement/PUD Amendments as <br />outlined in the Recitals above. <br />3. Developer shall comply with all applicable conditions of the original Development <br />Agreement/PUD.
