<br />ARDEN HILLS CITY COUNCIL - AUGUST 30, 1999 <br /> <br />4 <br /> <br />. <br /> <br />that the ordinance allows for a resident to hire a State licensed plumber to inspect a home for <br />conformance. <br /> <br />Mayor Probst concurred with the suggestion that the 30 day time limit be reinstated and <br />suggested it coincide with the completion of the City's inspection, which may be up to 24 <br />months from the time it starts. Councilmember Larson noted that, ifthe time limit for <br />compliance were to revert back to 30 days as of January 1,2001, the City inspections would have <br />to be completed by September of2000. Mr. Stafford stated that according to the contract, the <br />inspections must be completed by September of 200 1. However, he believed that the work <br />would be completed well before this time. <br /> <br />Councilmember Malone suggested that the City allow a 120 day time limit, up to the end of the <br />inspection cycle. At this point, most homes should be in compliance. Once the inspection cycle <br />is completed and the homeowncrs have been given sufficient time to correct their connections, <br />the 30 day time limit should be enforced. <br /> <br />MOTION: <br /> <br />Councilmember Malone moved and Councilmember Aplikowski seconded a <br />motion to adopt Ordinance #314, amending Chapter 28, Section 28-114, Arden <br />Hills City Code, with the following amendments to Subsection C: <br /> <br />1. <br /> <br />Second paragraph, first sentence, change the number of days from thirty to <br />one hundred and twenty. <br />Second paragraph, after the first sentence add, "After January 1, 2002, if <br />the violation is not corrected vdth thirty (30) calendar days after notice of <br />the violation has been delivered personally or by certified mail to such <br />person, owner, lessee or occupant, the City shall impose a surcharge in the <br />amount directed by the City Council. <br />Change thc word "may" in paragraph two, third and fourth line and <br />paragraph three, third line, to "shall." <br /> <br />. <br /> <br />2. <br /> <br />3. <br /> <br />The motion carried unanimously (5-0). <br /> <br />Mayor Probst stated that the Council was also asked to adopt the Ordinance summary for <br />publication in the City's official newspaper. <br /> <br />MOTION: <br /> <br />Councilmember Larson moved and Councilmember Aplikowski seconded a <br />motion to direct staff to publish the ordinance summary to provide legal notice of <br />the adopted ordinance. <br /> <br />Sincc the ordinance was only three pages in length, Councilmember Malone asked if it was <br />necessary to publish a summary, or if tile entire ordinance could be published. Mr. Post stated <br />that, with tonight's changes being made to Ordinance #314, it would make sense to publish the <br />ordinance in its entirety_ <br /> <br />. <br /> <br />Councilmember Larson withdrew his motion to direct staff to publish the ordinance summary <br />with the understanding that staff will publish the ordinance in its entirety_ <br />
