No. 49 is still valid: <br /> After discussion, Wingert moved, seconded by Feyereisen, that Council authorize <br /> preparation of an ordinance repealing Ord. No. 49, Sec. 6c, and other ordinances <br />. which are in conflict with H.S.B. regulations. Motion carried unanimously. <br /> CDC to be informed that permission. will be granted for cooling tower discharge <br /> into the sanitary sewer provided CDC furnishes Village SAC indemnification agreement, <br /> approved by Attorney Lynden, and installs flow meter approved by Engineer Lund. <br /> Case No. 74-17, McDonald's Corporation Declaratory Judgement Action <br />. After review of Lynden's proposed answer. substantiating Village Ordinances, Council <br /> concurred and authorized Lynden to answer complaint; matter not to go by. default. <br /> Lynden to keep Council apprised of status.) <br /> Open Meeting Law <br /> Lynden referred Council to his letter of 11-4-74. <br /> Interpretation of whether law refers to elected and/or appointed members of commit- <br /> tees was referred to Attorney Lynden for ... - - 'ol'in1011.- <br /> It was noted that Village has two official bulletin boards - one at .the Village Hall <br /> and one at Lake Johanna Elementary School - on which public notices are posted. <br /> (Attorney Lynden noted that if notices of Special MeetiDgs are publiShed, the notices <br /> ne:.... IIOt also be posted.) <br />. REPORT OF VILLAGE ENGINEER DONALD LUND <br /> Arden Manor Progress Report - J. Adams <br /> Lund referred Council to his letter re Arden Manor, submitted at last Council <br /> . meeting. <br /> Adams reported: <br /> 1. Water mai.ns and sewer mains are completed. <br /> 2. Now installing gas, telephone and power. <br /> 3. Not sure if roads will be completed this year. <br /> 4. 38 lots remain for patios to be poured. <br /> 5. Starting work on the building. <br /> Lund asked if the sewers are ready for inspection and asked that a drawing be sub- <br /> mitted of those lines ready to be inspected. <br /> Lund stated that the 51 unit area, outlined on map in yellow, is ready, from an <br /> engineering standpoint, for occupancy; hesitant to approve more until new well is <br /> campleted; wants to see pressure when this 51 unit area is filled. <br /> Adams requested Council approval of occupancy of the 51-unit area. <br />. After discussion, Crichton moved, seconded by Feyereisen, that Council rescind the <br /> hold on occupancy of 40 remaining homes in area outlined in yellow on'map, and placed <br />. back in hands of the Building Inspector, contingent upOn payment of appropriate in- <br /> spection fees. Motion carried unanimously. <br /> REPORT OF VILLAGE TREASURER RICHARD : 'KELLY <br /> Investmenta <br /> O'Kelly .reported the following investments: <br /> 1. October 29, 1974 - $148,OOO in American National Bank for 120 days <br /> at 9.05%. <br /> 2. November 6, 1974 - $135,OOO in First National Bank for 120 days at 8.75%. <br /> Crichton moved, seconded by Feyereisen, that Council ratify these investments. <br /> Motion carried unaniously. <br /> -4- <br />
