29 <br />TW185\1\1011577.v13 <br />The JDA, the City, the County and the JDA’s Engineers shall be named as <br />additional insureds on the policies, and the Developer shall file with the City, <br />the County and the JDA a certificate evidencing coverage prior to the City <br />issuing any permits. The certificate shall provide that the City and the JDA <br />must be given advance written notice of the cancellation of the insurance. <br />Upon request, the Developer will deposit annually with the JDA policies <br />evidencing all such insurance, or a certificate or certificates or binders of the <br />respective insurers stating that such insurance is in force and effect. <br />In lieu of separate policies, the Developer may maintain a single policy, <br />blanket or umbrella policies, or a combination thereof, having the coverage <br />required herein, in which event the Developer shall deposit with the JDA a <br />certificate or certificates of the respective insurers as to the amount of <br />coverage in force. <br />J. If building permits are issued prior to the acceptance of Infrastructure <br />Improvements, the Developer assumes all liability and costs resulting in <br />delays in completion of Infrastructure Improvements and damage to <br />Infrastructure Improvements caused by the JDA, Developer, its contractors, <br />subcontractors, material men, employees, agents, or third parties. No sewer <br />and water connection permits may be issued, and no one may occupy a <br />building for which a building permit is issued on either a temporary or <br />permanent basis until the utilities are accepted by the JDA Engineer in <br />writing.
