Page 1 of 2 <br /> <br />CONSENT ITEM – 8H <br /> <br />MEMORANDUM <br /> <br />DATE: April 14, 2025 <br /> <br />TO: Honorable Mayor and City Councilmembers <br /> <br />FROM: Jessica Jagoe, City Administrator <br /> <br />SUBJECT: JDA PC 25-002 – Ryan Companies – Outlot A - Stormwater Facilities Operation <br />and Maintenance Agreement <br /> <br /> Budgeted Amount: Actual Amount: Funding Source: <br /> N/A N/A N/A <br /> <br />Council Should Consider <br /> <br />Motions to approve, table, or deny the following: <br /> <br />• The Stormwater Facilities Operation and Maintenance Agreement with Ryan RCC I, <br />LLC based on the Joint Development Authority approval of JDA Planning Case 25-002 <br />on March 17, 2025. <br /> <br />Background <br />On March 17, 2025, the Joint Development Authority (JDA) approved a Preliminary Plat, Final <br />Plat, and Site Plan Review for Ryan Companies US, Inc. (“Applicant/Developer”) at Outlot A, <br />off of Rice Creek Parkway in Rice Creek Commons. The project was approved with 19 <br />conditions. The Developer will develop the site for a combined office and manufacturing use for <br />Micro Control Company, which the Applicant describes as an “advanced technology company <br />that specializes in Technology, R & D, and Advanced Technology Testing.”. The Applicant has <br />stated that the company provides “over 240 high-quality jobs, offers competitive wages and <br />benefits, and anticipates more than 20% growth in the next 5 years.” The proposed structure <br />would be an approximately 157,820 square foot building. <br />This development necessitated the need for several documents between varying parties (i.e. City, <br />County, Developer, Rice Creek Watershed District) based on applicability to be approved and <br />recorded such as a Development Agreement, Easement Agreements, Declaration of Restrictive <br />Covenants, and Stormwater Maintenance Agreements. For the City, this development requires a <br />Stormwater Facilities Operation and Maintenance Agreement which outlines the Developer’s <br />requirements and terms for construction and maintenance of the stormwater facilities on the
