Under Minnesota State Statute, there is an exemption for cities from surety requirements. In this <br />case, the RCWD Attorney has reviewed the waiver from the surety requirements signed by the <br />Headquarters Board CEO but has determined that a waiver by individual cities to be necessary. <br />The Cities of Shoreview and North Oaks have both agreed to and signed the waiver. The City <br />Attorney reviewed the waiver form and had no concerns with the language as written. <br />Budget Impact <br />The City had been slowly stepping up its increases to its Public Safety Capital Fund to support <br />the upcoming construction of the station and avoid large levy spikes. On December 9, 2024, the <br />City Council adopted the 2025-2029 CIP budget which included franchise fee assumptions of <br />$435,000 annually to offset debt service for the new fire station. <br />Permit fees are included in the overall project budget and allocated to the cities based on the 2025 <br />Cost Share formula. <br />Attachment <br />Attachment A: City of Arden Hills Acknowledgement of Financial Surety Obligations <br />Page 2 of 2 <br />
