b. Unique Circumstances. The plight of the property owner is due to circumstances unique to <br />the property not created by the landowner. <br />According to the Applicant, the climate issue is due to the design of the addition <br />constructed on the principal structure in 2009. The Applicant purchased the dwelling in <br />2015 and did not create the circumstances that have led them to request a variance. The <br />requested variance would address the issue created by previous improvements to the <br />Subject Property. <br />c. Character of Neighborhood. The variance, if granted, will not alter the essential character <br />of the neighborhood. <br />According to the Applicant, the proposed addition will not alter the character of the <br />neighborhood. The designed addition would be built in the same style and color as the rest <br />of the house and with the same materials. It will be 30 square feet constructed between the <br />principal structure and detached garage and the Applicant states that most people would <br />be unlikely even to notice it is there. <br />3. Economic Consideration. Economic consideration alone does not constitute a practical <br />difficulty. <br />The Applicant states that there is no economic advantage to the requested variance. They <br />state that a professional realtor shared that if the Applicant were to sell the home, it is likely <br />that less than 30 percent of the value of the vestibule addition would be recovered. <br />4. Access to Sunlight. Inadequate access to direct sunlight for solar energy systems shall be <br />considered a practical difficulty. <br />A solar energy system is not proposed. <br />Section 1325 — General Regulations, 1325.02 Accessory Uses, Subd. 3 Home Occupations <br />A. Home occupations are allowed as either accessory uses or conditional uses depending on the <br />characteristics of the operation. All home occupations shall comply with the following conditions: <br />1. It shall not result in traffic, parking, noise, light, fumes and odors to such an extent that it is <br />noticeable that the property is being used for non-residential purposes. <br />The Applicant states that the piano lessons business would not result in any noise, light, <br />fumes, or odors. As for traffic, the Applicant shares that there will be only one car <br />arriving at a time and will be parked in the Subject Property's driveway. One student <br />and their parent would be present at a time. <br />2. It shall be conducted entirely within the dwelling. <br />All of the business activity will be conducted entirely within the dwelling. The Applicant <br />has an approximate 160 square foot main floor space dedicated to perform the business <br />operations.
