<br />ARDEN HILLS CITY COUNCIL - MARCH 30. 1998 <br /> <br />10 <br /> <br />. Mayor Probst declared a recess at 9:08 p.m. The meeting was reconvened at 9:17 p.m. <br /> <br />B. Resolution #98-34, Adopting Final Bituminous Overlay, Assessment Roll, 5 year <br />Amortization <br /> <br />Mayor Probst explained the Council is asked to adopt Resolution #98-34 which would adopt the <br />final bituminous overlay assessment roll with a five-year amortization and set the assessment for <br />those property owners who are to be assessed over a five-year period for overlay work as part of <br />the 1998 Street Improvement Proj ect. <br /> <br />Mr. Post suggested the appeals be tabulated and placed into the record. <br /> <br />Councilmember Malone advised there are 12 written appeals, virtually all of them protesting to <br />the cost. He entered the following nine appeals into the record as follows: <br /> <br /> Res. The motion <br />carried unanimously (4-0). <br /> <br />Councilmember Malone reviewed the appeal of Susan Keim for 2056 Stowe Avenue based on <br />the assessment being excessive and indicating agreement to pay $37 per foot as a base cost minus <br />curb, gutter, the remaining storm water management, and indicating disagreement with being <br />charged a higher rate due to the City's and New Brighton's decision to delay the project. <br /> <br />MOTION: <br /> <br />. <br /> <br />MOTION: <br /> <br />Councilmember Malonc moved and Councilmember Aplikowski seconded a <br />motion to reject the appeal by Susan Keim, 2056 Stowe Avenue, since the <br />Council believes the cost is consist with the benefit and the assessment was <br />protested in terms of tbe prior assessment amount noticed which has already been <br />substantially rcduced and the Council has determined to fund stormwater system <br />costs from the SWM Fund. The motion carried unanimously (4-0). <br /> <br />Councilmember Malone moved and Councilmember Aplikowski seconded a <br />motion to reject appeal to overlay the road by Michael and Jean Hill, 3280 Lake <br />Johanna Boulevard, since Sandeen Road does not abut their driveway because it is <br />
