However, one area that the City has an <br />easement on does not flood. Therefore, the City should obtain an easement of the areas that do <br />flood. Staff recommends getting rid of the easement that does not flood and then removing the <br />triangular easement from Parcel B and relocate it southwesterly which is an area that does flood. <br /> <br />John McClung, applicant, stated he met with stafImembers and thought they had reached an <br />agreement about removing dirt from one area and the issue offill to another area is new to him. <br />He stated that the easement line on Parcel B comes to a point very close to the building pad. He <br />explained that he has a buyer for this site and they drew out a building plan which would not <br />impact the easement location. Mr. McClung stated he does not believe the easement line is in a <br />bad location based on their drawing. I-Ie advised he did ask about filling that easement area <br />without creating a compensatory area and explained that it would only add an extra one-third of <br />an inch of water. He stated it appears he is being asked to go to a fair amount of work to fill one <br />area and dig in another to save one-third of an inch of water. Mr. McClung asked why the <br />easement is not made 3/1 Oths of an inch larger (916.3 elevation) to allow the area to be filled <br />without requiring the cut. Mr. McClung stated he wants to avoid making the cut due to the <br />expense and slopes it would create. He asked if the overall easement elevation can be increased <br />instead. <br /> <br />Mr. Greg Brown, City Engineer, clarified it would be 1/I00th of a foot, not 3/1 Oths of an inch. <br /> <br />Mr. McClung stated he would prefer to increase the overall easement elevation to 916.3. Also, <br />filling the easement would require permission from the Rice Creek Watershed District which is <br />an additional cost. <br /> <br />Mr. Brown stated that from and engineering standpoint it would not matter if the area is filled <br />since the pond will rise to a certain level. He stated that if increasing the elevation is acceptable <br />to the applicant, it would be all right with him. <br /> <br />Mr. Ringwald stated that he will defer to the City Engineer. <br /> <br />Mr. McClung stated he understands that a walkout design level would have to be at that elevation <br />but a full or half basement (not walkout) could be below the I DO-year flood elevation. The City <br />Engineer stated he would not support that since ground water would impact that type of <br />basement. <br /> <br />Mr. McClung stated he researched this issue and found that in the last 20 years there was one 24 <br />hour period that received a I DO-year storm. <br /> <br />Mayor Probst commented on the need to assure an understanding and avoid problems with <br />subsequent owners. Mr. Ringwald stated the intent is to obtain adequate storage and make Parcel <br />B more desirable. <br />
