<br />. <br /> <br />, <br /> <br />4t <br /> <br />ARDEN HILLS CITY COUNCIL - AUGUST 31. 1998 <br /> <br />25 <br /> <br />Mayor Probst noted the suggestion that Mr. Zehring, the Welsh Companies, may be back and <br />suggested that only happen if he improve things on this own and not seek additional funds. <br /> <br />Mr. Fritsinger explained that thc last conversation with Mr. Zehring and his attorney was that the <br />significant issue is the City has withheld the certificate of occupancy until the aesthetic issues <br />comply with what the Council reviewed and approved. The problem from their perspective is <br />that this is an $18 million project slated for closing today and tomorrow and the legal issues of <br />withholding an certificate of occupancy for aesthetic issues is not well received by the attorneys. <br /> <br />It was noted that Mr. Ringwald talked with Mr. Zehring and Mr. Hart about how to resolve some <br />of these items. One of the difficult issues is that the fourth building does not match the third <br />building aesthetically. The fourth building is in the process of being sold and will then be <br />privately owned. Because of that the architect made some minor changes, such as having the <br />green strip which is the corporate color. The City, in reviewing the building plans, had requested <br />review of the color schemes. On that issue there was reference in the building plans about the <br />building color and it was thought to be the same color as the building next door and approved <br />under that impression. <br /> <br />Mr. Fritsinger reported that discussion occurred about that issue and that this was not "flagged" <br />on the plans to draw attention to it. They agreed to repaint that stripe to match building three and <br />to add a band, and the coping will be investigated to see if it can be painted to match the greens. <br />The replacement of the windows and coping is too expensive. <br /> <br />Mr. Fritsinger stated that Mr. Zehring indicated be will provide a response by the end of next <br />month. <br /> <br />Councilmember Malone stated that the PMS color system is used by a printer, not a paint <br />manufacturer, and is an invalid argument. <br /> <br />Councilmember Larson stated that he remembers a discussion with the Planning Commission <br />about how the building would look and their indicating the buildings would be a mirror image of <br />each other. <br /> <br />Mr. Fritsinger explained their argument is that the buildings are still a mirror image and the color <br />difference is insignificant and would not be noticed by anyone. <br /> <br />ADJOURN <br /> <br />MOTION: <br /> <br />Councilmember Keim moved and Councilmember Aplikowski seconded a motion <br />o adjourn the meeting at ] 0:42 p.m. The motion carried unanimously (5-0). <br /> <br /> <br /> <br />Brian Fritsinger <br />City Administrator <br />
