,-tt <br />EN HILLS <br />CITY OF ARDEN HILLS <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br />RESOLUTION NO.2025-042 <br />RESOLUTION APPROVING A VARIANCE FOR THE SUBJECT <br />PROPERTY 3609 PASCAL AVENUE <br />WHEREAS, on April 9, 2025, Logan McCarthy ("Applicant") applied for a side yard <br />setback for a corner lot variance from the City Code for the property located at 3609 Pascal Avenue <br />and legally described on Exhibit A attached hereto ("Subject Property"); <br />WHEREAS, the Applicants are proposing to demolish the existing structures and rebuild <br />one principal structure on the Subject Property which would require a variance to allow a side <br />yard setback for a corner lot of 31.9 feet versus 40 feet as required by city code; <br />WHEREAS, a variance may be granted when it is in harmony with the general purposes <br />and intent of the zoning ordinance if enforcement of a provision in the ordinance would cause the <br />landowner practical difficulties; <br />WHEREAS, the City Council directed Staff to prepare a Land Use Application Public <br />Policy Notification to notify all property owners within 500 feet of Subject Property when a request <br />for the Planning Commission is to occur related to a land use application that does not require a <br />public hearing; <br />WHEREAS, the City's obligation has been met where the Arden Hills Planning <br />Commission, acting as the Board of Adjustment and Appeals, duly held a hearing on May 7, 2025, <br />at which time all persons desiring to be heard concerning this application were given the <br />opportunity to speak thereon; <br />WHEREAS, on May 7, 2025, the Planning Commission recommended approval with <br />conditions of the reduced side yard setback for a corner lot variance for the Subject Property based <br />on the findings of fact and submitted plans by a 5-0-1 vote. <br />NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE <br />CITY OF ARDEN HILLS: <br />Hereby adopts Resolution 2025-042 approving Planning Case 25-002 for a variance <br />request at the Subject Property 3609 Pascal Avenue for redevelopment of the parcel with a reduced <br />side yard setback for a corner lot. <br />1 <br />
