The plight of the property owner is due to circumstances unique to <br />the property not created by the landowner. <br /> <br />According to the Applicant’s written narrative, the corner lot configuration, the property’s <br />proximity to County Road E, and the required side yard setback for a corner lot are unique <br />challenges not created by the landowner. The current location of the driveway presents <br />safety hazards and significant winter maintenance burdens unique to the property as a <br />result of the Subject Property’s orientation and access. <br /> <br />c. Character of Neighborhood. The variance, if granted, will not alter the essential character <br />of the neighborhood. <br /> <br />The Applicant states that the intent of the proposed variance would allow for a reasonable <br />building footprint while maintaining appropriate distances from all surrounding structures <br />and streets. It is stated that the proposed relocation of the driveway aligns with the <br />neighborhood’s typical layout, enhances overall safety and visual consistency and <br />enhances the character of the block. <br /> <br />3. Economic Consideration. Economic consideration alone does not constitute a practical <br />difficulty. <br /> <br />The Applicant states that the variance request is based on a broader set of livability, safety, <br />and functional design issues rather than economic considerations. <br /> <br />4. Access to Sunlight. Inadequate access to direct sunlight for solar energy systems shall be <br />considered a practical difficulty. <br /> <br />A solar energy system is not proposed. <br /> <br />Additional Review <br /> <br />Building Official <br />The Building Official has reviewed the plans and has no additional comments at this time. A <br />Building Permit will be required prior to any demolition or construction activity taking place. <br /> <br />Public Works Director/City Engineer <br />The Public Works Director/City Engineer has reviewed the plans and has no additional comments <br />at this time. Public Works permits will be required prior to any land disturbance, utility, or right- <br />of-way work. These items have been included in the drafted conditions of approval. <br /> <br />Ramsey County Public Works <br />The Ramsey County Public Works Department has reviewed the plans and has no additional <br />comments at this time. Ramsey County permits will be required for the driveway work on County <br />Road E. The drafted conditions of approval include requiring the Applicant to attain the necessary <br />Ramsey County permits. <br /> <br />Findings of Fact <br /> <br />The Planning Commission reviewed this application at their May 7, 2025 meeting and have offered <br />the following findings of fact for your consideration:
