<br /> <br />2 <br />a subdivided portion of the land is situated at 1700 Highway 96 West, in the City of Arden Hills, <br />County of Ramsey, State of Minnesota, and is legally described as set forth on Exhibit A (“Subject <br />Property”). North Heights Lutheran Church, a Minnesota nonprofit corporation, (“NHLC”) <br />currently owns the Subject Property which contains a single structure that acts as a house of <br />worship. The Subject Property currently has split zoning with a majority of the site zoned R-1, <br />Single Family Residential District, and the northwest portion of the Subject Property zoned B-1, <br />Limited Business District. The Subject Property is also within the Shoreland Overlay District <br />based on its proximity to Round Lake. The Developer proposes to subdivide the Subject Property <br />pursuant to the plat of Arden Heights Addition, Ramsey County Minnesota (the “Plat”). The Plat <br />would dedicate approximately 16.80 acres of the Subject Property as a public right-of-way and, as <br />indicated in the PUD – Master Plan Development Documents, the remainder of the Subject <br />Property, comprised of approximately 41.10 acres, would be subdivided into two lots: (i) Lot 1, <br />Block 1, Arden Heights Addition, Ramsey County, Minnesota, comprised of approximately 10.74 <br />acres (the “Development Property”); and (ii) Lot 2, Block 1, Arden Heights Addition, Ramsey <br />County, Minnesota, comprised of approximately 30.36 acres (the “Remainder Property”). The <br />Developer proposes to construct a 162,819 square foot, 119-unit age restricted multiple family <br />dwelling on the Development Property (the “Building”) and to construct additional parking on the <br />Remainder Property for the existing house of worship (collectively, the “Development”). The PUD <br />further indicates that the land use and proposed flexibility will be exclusive to the Development <br />Property. <br /> 2. CONDITIONS OF APPROVAL. <br /> A.
