In the same section of the zoning code, item 9. establishes Fences in Non-Residential Situations
and Exceptional and Unusual Circumstances in Residential Districts. Deviation from these
requirements for fences, walls and landscape screening may be permitted after Planning
Commission review and Council approval of a site plan with documentation showing the unusual
circumstances justifying the proposed deviation and plans for the proposed fence, wall, or
landscape screening. Tree removal associated with the proposed noise barrier wall would be
subject to Section 1325.055 Tree and Landscaping Preservation in the Zoning Code.

The City Engineer/Public Works Director has reviewed the noise barrier wall concept and provided
comment that the placement/location of the wall should not impact City operations as the adjacent
segment of trail is in such condition that it could easily fail if used during the project. Another note
is a question of if the Applicant has a landscaping maintenance plan for the side of the wall adjacent
to the City trail.

Budget Impact

N/A

Attachments

A.
