Page 3 of 3 <br /> <br /> <br />In the same section of the zoning code, item 9. establishes Fences in Non-Residential Situations <br />and Exceptional and Unusual Circumstances in Residential Districts. Deviation from these <br />requirements for fences, walls and landscape screening may be permitted after Planning <br />Commission review and Council approval of a site plan with documentation showing the unusual <br />circumstances justifying the proposed deviation and plans for the proposed fence, wall, or <br />landscape screening. Tree removal associated with the proposed noise barrier wall would be <br />subject to Section 1325.055 Tree and Landscaping Preservation in the Zoning Code. <br /> <br />The City Engineer/Public Works Director has reviewed the noise barrier wall concept and provided <br />comment that the placement/location of the wall should not impact City operations as the adjacent <br />segment of trail is in such condition that it could easily fail if used during the project.
