Motion carried unanimously. <br /> Business from the Floor <br /> None. <br /> REPORT OF VILLAGE ATTORNEY JAMES LYNDEN <br /> Case No. 80-26, Special Use Permit for Diesel Fuel Storage <br /> Tank - Columbia Transit, 1901 West County Road F <br /> Lynden referred Counci I to draft of Special Use Permit - Case <br /> No.. 80-26. <br /> Woodburn moved, seconded by Hanson, that Council approve the <br /> Special Use Permit as amended (Woodburn, Hanson, Crepeau voting <br /> In favor of the motion; Crichton voting in opposition). <br /> Case No. 80-24, Resolution No. 80-46, Requesting Ramsey County <br /> to Place Excess Right-of-way For Public Sale <br /> Hanson moved, seconded by Crichton, that Council adopt Resolu- <br /> tion No. 80-46, RESOLUTION REQUESTING RAMSEY COUNTY TO PLACE <br /> EXCESS RIGHT-OF-WAY ON LEXINGTON AVENUE FOR PUBLIC SALE. Motion <br /> carried unanimously. <br /> Sale of Storage Garage at 3242 New Brighton Road and Pllgren <br /> Property <br /> Lynden advised that he received the Abstract of Title for the <br /> storage garage tonight which he will up-date; noted that the <br /> City does not have an Abstract of Title for the Pi I gren property <br /> which will take some time to prepare. <br /> Lynden was req ues ted to pre pare the Contract for Deed; up-date <br /> of the Abstracts of TI tie to be completed before f I na I paymen t <br /> on contract. <br /> Park Dedication - East Side Beverage <br /> Lynden re fe rred Counc i I to his letter of 9/26/80 re: Ph i lip T. <br /> Resha and Wi I II am F. Farhet, Sr. vs. The City of Arden Hills. <br /> . Hanson moved, seconded by Woodburn, that Counci I authorize <br /> preparation of a check In the amount of 50% of the sum origin- <br /> a II y paid by the plaintiffs. <br /> After discussion, Crichton moved to amend the motion to include <br /> interest @ 9.8% from 4/30/79. Amendment was seconded by Hanson <br /> and carried (Crichton, Hanson Crepeau voting in favor; Woodburn <br /> voting in opposition). <br /> Original motion carried unan I mous Iy. <br />
