<br />. <br /> <br />. <br /> <br />. <br /> <br />Minutes of the Arden Hills Regular Council Meeting, 9-9-91 <br />Page 3 <br /> <br />fIRING (Cont'd) Karen Johnson, 3803 New Brighton Road, stated she is not <br />~ to paying a fair share of the assessment, <br />however, her property is adjacent to the Hans Hagen parcel of larxl. which was <br />recently rezoned. She objected to the proposed develq:anent of the Hagen parcel, <br />stating the use would decrease the value of her property. Johnson cited in=eased <br />traffic arxl. noise as her concerns relating to the proposed development of this <br />parcel. <br /> <br />Mayor Sather asked if there were any further comments fram the floor arxl. hearing <br />no response, closed the public hearing at 7:47 p.m. <br /> <br />Councillnember Malone explained the city recently adopted an assessment policy <br />which provides that water arxl. sewer iJrprovements would normally be assessed 100 <br />percent to the benefitted properties, usually on a front footage basis. He <br />indicated that because of the unique circumstances surrounding this iInprovement, <br />the Council retained a professional a"''''essor to review the properties involved in <br />the inprovement arxl. determine the extent of benefit to the properties. He <br />indicated it is his opinion the appraised am:JUI'lts provide a fair arxl. appropriate <br />method of detennining the extent to benefit to affected properties. Malone <br />advised the city Attorney recommended following this procedure, based on the <br />rationale outlined prior to the public hearing. <br /> <br />Councillnember Hicks questioned if the application for deferred assessment is <br />handled in conjunction with the adoption of the assessment roll. <br /> <br />AttoJ:ney Filla outlined the procedures for determining if the property owner <br />requesting deferred assessment meets the =iteria established in the deferred <br />assessment application. He indicated the applicant should contact City staff to <br />obtain further information regarding this matter. <br /> <br />Mayor Sather advised the property owners have thirty days fram the date of <br />adoption of the assessment roll to pay the full assessment amount without <br />interest . <br /> <br />Hicks moved, seconded by Malone, to awrove Resolution <br />No. 91-54-1, Adopting Final Assessment Roll for the Cleveland Avenue <br />~, in the am:JUI'lt of $176,000.00, as per the rate per parcel determined <br />in the Davis & lagennan, Inc., appraisal document dated July 9, 1991. Motion <br />carried unaniJnously. (5-0) <br /> <br />CASE #91-05; <br />PRELIMINARY PlAT, <br />3191 NO. LEXINGION, <br />WARREN HANSON <br /> <br />Council was referred to the Planner's report arxl. Planning <br />Commission minutes dated 9-4-91, regarding case #91-01, <br />awlication for Prelilninary Plat, 3191 North Lexington <br />Avenue, Warren Hanson. <br /> <br />'lhe Planner reviewed the background of the this application, which was previously <br />suJ:mitted as a minor sub:iivision. Bergly explained Council indicated a preference <br />for the proposal to be suJ:mitted as a plat, to insure the dedication of the short <br />segment of street known as Shoreline lane. <br /> <br />Bergly stated the Planning Commission recommended approval of the plat, with <br />three conditions: 1. Lots 2 arxl. 3 be combined in a manner acceptable to Ramsey <br />County Surveyor; 2. Variances of 10 arxl. 8.74 feet, respectively, be awroved for <br />the width of IDt 1, Block 1 arxl. IDt 1, Block 2; arxl., 3. 'lhat the city Engineer <br />establish the necessary utility arxl. drainage easements (existing easements are <br />indicated on the proposed plat). <br />
