• <br /> Arden Hills Council 4 September 28 , 1992 <br /> and divide the anticipated cost amongst those properties <br /> accordingly . <br /> John Halverson , 3517 Ridgewood Road, pointed out that the <br /> drawing Graham was using to illustrate did not accurately <br /> locate his property . Graham stated that the drawing is not <br /> to scale, but simply a crude drawing to be used as a visual <br /> tool . Graham stated that according to his calculations , 4% <br /> of the Halverson property contributes to the runoff which is <br /> ponding and creating the problem. <br /> Dale Noyed, 3505 Ridgewood Road, stated that the water <br /> problem on his property has existed for years , and years ago <br /> a drainage pipe was installed to drain water from his <br /> backyard to Lake Johanna . He stated that he believes the <br /> City receives easement rights from some property owners to <br /> lay the pipe , and is , therefore , obligated to maintain that <br /> pipe . He reported that he has asked former Councilmembers <br /> and Public Works employees several times to drain that pipe, <br /> to no avail , so he has purchased three pumps to remove water <br /> from his property . He commented that the City has been <br /> • negligent in maintaining the pipe, which has worsened the <br /> problem, therefore there should be no assessment to property <br /> owners in the area . <br /> Mayor Sather arrived at this time (7 : 54 p .m. ) . <br /> Councilmember Malone asked if the City , in fact , received <br /> easements and laid the pipe . Engineer Graham stated that <br /> the only easement that he is aware of is the sewer line <br /> easement , that he does not know who laid the pipe , and that <br /> the pipe was apparently laid back in the ' 60 ' s or ' 70 ' s when <br /> these kinds of drawings were not retained as City records as <br /> they are now. Councilmember Mahowald commented that the <br /> uncertainty as to who laid the pipe is a complicating factor <br /> that everyone must keep in mind. <br /> William Thornton, 3510 Siems Court , stated that he is <br /> representing the Halversons (3517 Ridgewood Road) , the <br /> Lindbergs ( 3520 Siems Court ) , the Mulcahys (3530 Siems <br /> Court ) , and Thorntons ( 3510 Siems Court ) at those residents ' <br /> request ; he provided booklets to Council , the contents <br /> prepared jointly by these residents . <br /> He asked Graham to state the purpose of the topography map <br /> of the area and when it was drawn. Graham stated the a <br /> • topography map indicates contours and elevations of land, <br /> that this map was drawn in 1973 . Thornton emphasized that <br /> the map does not reflect changes to the topography of the <br /> area which have been made since 1973 . <br /> Thornton stated that the lot behind the McGuire property is <br />
