<br />. <br /> <br />. <br /> <br />. <br /> <br />, <br /> <br />MINUTES <br />CITY OF ARDEN HILLS, MINNESOTA <br />WORKSESSION CITY COUNCIL MEETING <br />APRIL 20, 1993 <br />4:30 p.m. - CITY HALL <br /> <br />CALL TO ORDERIROLL CALL <br /> <br />Pursuant to due call and notice thereof, Mayor Sather called to order the Worksession <br />City Council meeting at 4:30 p.m. Present: Mayor Sather, Councilmembers Paul <br />Malone, Dale Hicks, Beverly Aplikowski and Dennis Probst. Also present were: Clerk <br />Administrator Dorothy Person; City Accountant Terry Post; City Attorney Jerry Filla, <br />Building Official David Kriesel, and Recording Secretary Renee' Kaulfuss, <br /> <br />AGENDA ADOPTION <br /> <br />Mayor Sather noted that he spoke with representatives from Everest Group and they are <br />not prepared to discuss their updates this evening, He suggested that Item #8 Everest <br />Group Update be moved under Council Comments, <br /> <br />MOTION: Probst moved, seconded by Aplikowski, to adopt the April 20" 1993 <br />worksession agenda with the change as noted above, Motion carried <br />unanimously (5-0), <br /> <br />Review of Arden Manor Court Settlement Agreement Relating to SAC Charges. <br />Attorney Filla referred to the agreement provided in the April 20 packet and stated the <br />agreement has been approved by the MWCC and the Park owners, All that remains is <br />for the City to authorize the agreement and execution of the agreement by the Mayor <br />and City Administrator. MWCC is holding the initial check from the Park owners until <br />receipt of the agreement by the Mayor and City Administrator. A question arose to the <br />procedure needed to be taken if payments were not made, Filla stated the Park owners <br />could be assessed and monies owed certified to the county. No Public Hearing would be <br />necessary. MWCC will notify the City if payment is not received, Basically, the City is <br />the agency for collection in this manner. <br /> <br />MOTION: Probst moved, seconded by Malone, to approve the agreement and direct <br />execution of the agreement by the Mayor and City Administrator, Motion <br />carried unanimously (5-0). <br /> <br />Review Request From State of Minnesota For Installation Of A 10 Inch Water Main <br />Pipe. <br />City Administrator referred to the draft of an agreement received from the City of <br />Mounds View which requests the City of Arden Hills to allow the City of Mounds View <br />to provide water service to the State of Minnesota at the NW corner of the TCAAP <br />property, Attorney Filla noted that he does not agree with Item #2 in which the City of <br />Arden Hills would be entered into a hold harmless agreement. Discussion followed <br />regarding the water main pipe being State owned and maintained, Probst commented it <br />should be made very clear the jurisdiction of this property as it relates to the City of <br />Arden Hills and that MNDOT be required to comply with all our City's regulations <br />relating to sewer and water. There would have to be an agreement for the City of <br />Arden Hills to have emergency excess to this pipe, Eventually if City water is extended <br />to that site location, Mounds View would cease providing water and it would be <br />provided by the City of Arden Hills, It was recommended that the State of Minnesota <br />
