They're off there <br />and we didn't notify them either, for that matter. I don't <br />think that would carry through if it went to court. <br /> <br />MR. The drainage facilities do drain your <br />property and that's another $5,000. Not necessarily your <br />particular property, but the property along there. If I <br />could just stop here. for a moment - without closing the <br />hearing - to discuss with the Council what their feelings <br />are, whether they might want to assess this, and whether we <br />should keep the public hearing going, or do you have feelings <br />that you might not want to assess this, in which case we <br />won't have to keep it going. <br /> <br />- <br /> <br />COUNCILMAN McALLISTER: I really think, if it came to a <br />court case, that we could prove benefit to the property <br />because of the walkway and the fact that th~widening, . <br />including (inaudible) provides better ac~ess to your homes. <br />It's a definite selling point - you can get there, it's <br />plowed and all that. However, as I said, we did not assess <br />for curb and gutter for the other part of Lexington. I was . <br />opposed to the impcovement of Lexington farther south - where <br />I live - but now that it's there - I signed that. petition - <br />but now that it's there I like it. It's a lot nicer to <br />drive on and you drive it every day. It does make a <br />difference. From what has been said here before, I think <br />we probably - my vote will be to find the $66,000 and maybe <br />postpone another project somewhere else. <br /> <br />. <br /> <br />MAYOR WOODBURN: Councilman Mulcahy, do you have any <br />feelings on this - that could maybe help shorten it up? <br /> <br />COUNCILMAN MULCAHY: Yes, I think we want to shorten it <br />up. I have quite a bit of sympathy for the residents - we <br />all do - who don't understand why they were summoned out here <br />tonight for the prospect of paying for curb and gutter and <br /> <br />-12- <br />
