Motion to Accept Annual Review of Data Practices Policy
Councilmember Holden asked if the five business days was enough time to allow for an
inspection of the policy.
City Attorney Bjerkness reported the new five business day statutory language is triggered when
City staff notifies the data requester that the data is available for pickup or inspection. She
indicated if this person cannot make it to City Hall in five days, they could work something out
with City staff. However, if there is no response in five days, City staff is under no obligation to
continue to fulfill the data request.
Councilmember Holden commented on how someone could be out of the country or on vacation
and they may not be checking emails or voicemails.
City Attorney Bjerkness stated this doesn't mean the City can't continue fulfilling the data
request at a later date, but under the new State law, the City does not have to.
