<br />. <br /> <br />" <br /> <br />Minutes of Regular Council Meeting <br />Village of Arden Hills <br />Monday, February 22, 1982 - 7:30 p.m. <br />Village Hall <br /> <br />Call to Order <br />Pursuant to due call and notice thereof, Mayor Woodburn called the <br />meeting to order at 7:35 p,m. <br /> <br />Roll Call <br />Present - Mayor Robert Woodburn, Councilmen Janet Hollenhorst, <br />Diane McAllister, Maurice Johnson <br /> <br />. Absent - Councilman Dale Hicks <br /> <br />Also Present - Village Attorney James Lynden, Clerk Administrator <br />Charlotte McNiesh, Deputy Clerk Dorothy Zehm <br /> <br />Approval of Minutes <br />Johnson moved, seconded by McAllister, that the Minutes of the <br />Council Meeting of February 8th be approved as amended. Motion <br />carried unanimously (4-0). <br /> <br />Business From The Floor <br />None <br /> <br />REPORT OF VILLAGE ATTORNEY JAMES LYNDEN <br /> <br />Draft of Development Agreement - Case No. 81-23 <br />Arden Oaks, Derrick Land Company <br />Council was referred to draft of development agreement between the <br />City of Arden Hills and Derrick Land Company. In review, Lynden <br />reported three comments from Bond Counsel Popovich: <br /> <br />1. p.8(c) 10 year special assessments payment <br />period is too long; suggested a 6-year maximum, <br />recommended 3-5 years. <br /> <br />2. ~.8(c) suggested deletion of reference to Minnesota <br />Statutes relative to interest rate - change <br />to maximum interest as provided by law. <br /> <br />3. suggests adding a waiver of developer's right to <br />challenge the amount of assessment. <br /> <br />Lynden said he is agreeable to all 3 points. <br /> <br />Developer Laughinghouse said the agreement is acceptable if it is <br />consistent with Village ordinances; suggested the following modi- <br />fications: <br /> <br />1) p.l (Second Whereas paragraph) delete "all related docu- <br />men ts II . <br /> <br />. <br /> <br />2) p.l Improvements Necessary - noted that if "developer <br />improvements" means "site grading" he agreea; noted that <br />City Improvements should mean "within the plat of Arden <br />Oaks, and exclude improvements outside of Arden Oaks". <br /> <br />3) p.2 Developer's Warra~ - Lauhinghouse said the Devel- <br />oper's interest in the Subdivision is "vendee under con- <br />tract for deed". <br /> <br />4) (i) Site Grading Plans - should read Subsection (b) <br />instead of (a). Laughinghouse noted that all documen- <br />tation, if not already filed, will be filed for Village <br />Engineer approval. <br /> <br />5) (j) Supervision - Feels the double supervision not <br />necessary; will work this out with the Village Engineer. <br />
