CONSENT ITEM - 8C <br />lt <br />--ARQEN HILLS <br />MEMORANDUM <br />DATE: September 8, 2025 <br />TO: Honorable Mayor and City Councilmembers <br />Jessica Jagoe, City Administrator <br />FROM: Elena Fransen, AICP, Senior Planner <br />SUBJECT: Planning Case #25-005— Arden Plaza, LLC Planned Unit Development <br />Amendment, 3529 Lexington Avenue North <br />Council Should Consider <br />Motions to approve, table, or deny the following: <br />• Amended Planned Unit Development Agreement for Arden Plaza, LLC based on the City <br />Council approval of Planning Case 25-005 on July 28, 2025. <br />Background <br />The City Council previously approved a Master and Final Planned Unit Development for Arden <br />Plaza, LLC (the "Developer") at 3529 Lexington Avenue N ("Subject Property") in 2009 for the <br />phased redevelopment of the I I acre site. A total of 97,035 square feet of retail and commercial <br />building space was approved under the original PUD. The total square footage included the <br />existing 35,647 square foot Building #5, where the Subject Property is located, and the original <br />PUD established the building's use as retail. <br />Brett Foss of Odds & Ends Again ("Applicant"), submitted a land use application for a Planned <br />Unit Development Amendment, proposing an amendment to the PUD to allow for a Class I thrift <br />store use in an approximately 6,943 square foot tenant space within the 35,647 square foot multi - <br />tenant building on the subject property. A Planned Unit Development Amendment is required at <br />this location to allow for a thrift store use due to the current permitted use in the Planned Unit <br />Development Agreement is limited to retail sales and services. <br />On July 28, 2025, the City Council approved a Planned Unit Development Amendment with five <br />conditions. These changes require an Amendment to the Development Agreement between the <br />City and the Developer. The City Attorney has prepared the Agreement and the document has been <br />reviewed and approved by the Developer and staff (Attachment A). <br />Page 1 of 2 <br />
