City Council Summary Memo — Work Session #4— Zoning Ordinance Update— October 8, 2025 <br />c. Clarification is being sought about how nurseries should be addressed in the code. The <br />principal use as defined is focused on property that is used for a commercial nursery. It <br />is HKGi's understanding that the City may want to address the potential for a residential <br />homeowner to grow and sell plants on their property. This type of use would be <br />addressed in the accessory use table as the residence is the principal use. Currently, the <br />City's home occupation regulations do not apply as the use is conducted outside of the <br />residence and involves patrons visiting the site for sales. <br />HKGi is seeking clarification on whether the code update process should identify a path <br />for this use to be allowed. One option would be to specifically list this use as an <br />allowable accessory conditional use and outline specific standards. Councilmembers are <br />advised that with this approach if a conditional use permit were to be granted for a <br />property, the use would be allowed to continue even if the property were to be sold. Ar <br />alternative process that currently is not used in Arden Hills, but is used in other <br />communities, is an interim use permit. An interim use permit is similar to a conditional <br />use permit, however, the use does not continue indefinitely but can be terminated <br />based on specific conditions. In this case, it could be extinguished with the sale of the <br />property. If the interim use permit approach were to be considered, additional <br />procedures would need to be established for an interim use permit process. <br />5) Schools, general. <br />a. Definition: Nursery, primary, elementary and secondary schools. <br />b. As part of previous discussions it was noted that in -home schools should be included <br />with this use. Clarification is being sought to define what is meant by an in -home school. <br />In addition, it should be noted that an in -home school would generally be considered an <br />accessory use as the residence is the primary use. If the City were to include an in -home <br />school as an accessory use it is recommended that potential impacts of such a use on <br />surrounding residential properties be identified so standards could be crafted. <br />DEVELOPMENT STANDARDS <br />The City's current code has additional design standards for new development, redevelopment, and <br />modifications to existing sites within the MU (B-2) and BP (B-3) Districts. The intent of the design <br />standards are to promote a high level of architectural, landscaping, and site design. The following is an <br />example of what is included: <br />• Minimum building material standards <br />• Requirements for portions of the building to be built on the front setback line <br />• Fagade treatment on all sides with architectural elements and the breaking up of long expanses <br />of walls <br />• Entrances with awnings or overhangs <br />4 <br />
