WHEREAS, the City's obligation has been met where the Arden Hills Planning <br />Commission reviewed the application on October 8, 2025. All written comments submitted in <br />advance of the meeting were presented to the Planning Commission; and <br />WHEREAS the Planning Commission considered the Applicant's request for a Variance <br />and, as such voted 7-0 in favor of recommending approval with conditions. <br />NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE <br />CITY OF ARDEN HILLS: <br />Hereby adopts Resolution 2025-069 approving Planning Case 25-011 for a Variance for <br />the property located at 3254 Hamline Avenue North to construct a new, larger deck with a 8.8 foot <br />rear yard setback on the Subject Property. <br />BE IT FURTHER RESOLVED that City Council approves Planning Case 25-011 for a <br />Variance request at the property located at 3254 Hamline Avenue North, based on the Findings of <br />Fact and the submitted plans in the October 27, 2025, Report to the City Council, as amended by <br />the following conditions: <br />1) A Building Permit shall be issued prior to the commencement of construction. <br />2) The proposed building shall conform to all other standards and regulations in the City <br />Code. <br />3) The Applicant shall be responsible for obtaining any permits necessary from other <br />agencies, including but not limited to, RCWD and DNR, prior to the start of any site <br />activities. <br />4) Final grading, drainage, and site plans shall be subject to approval by the Public Works <br />Director/City Engineer and Community Development Director prior to the issuance of a <br />grading and erosion control permit or other development permits. <br />5) The submitted shoreland mitigation plans shall be completed in accordance with City Code <br />Section 1330.03 Subd. 7. E. within one year of the plan's approval unless otherwise <br />approved by the City. <br />Page 2 of 4 <br />
