<br />. <br /> <br />Minutes of Regular Council Meeting <br />January 9, 1984 <br />Page Six <br /> <br />Christiansen expressed SOme concern about the closeness of the <br />cul-de-sac to the lake; appears to be about 50'; also about access <br />to lot 9, over the sanitary sewer ease~ent. It was explained that <br />a driveway can be constructed on or across an easement. Christiansen <br />said covenants and restrictions can create problems as well as <br />regulate; feels covenants placed on the lots now will not solve <br />all problems of the on-going use. <br /> <br />After discussion, it was recommended that Council list points of <br />concern to be sddressed in the covenants, not necessarily an <br />exclusive list. <br /> <br />Mulcahy withdrew his statement that he would not vote for <br />Preliminary Plat approval tonight; will vote for approval with the <br />understanding that covenants will be presented as soon as possible <br />before the January 30th meeting of Council. <br /> <br />. <br /> <br />Christiansen asked if DNR approves dockage. Woodburn said they <br />regulate permanant docks; take little control of removable docks; <br />noted that cities can regulate docks. <br /> <br />Hicks moved, seconded by Mulcahy, that Council approve the _ <br />Preliminary Plat of Lametti Addition as proposed, recognizing that <br />Lot 2, Block 2 is 700 square feet short of the area requirement of <br />14,000 square feet, and subject to: <br /> <br />1. Engineer's approval of streets, utilities, grading and <br />drainage plans. <br /> <br />2. Resolution of Park Dedication. <br /> <br />3. Approval of restrictive covenants by. the ~tty.Council. <br /> <br />4. Relocation of Lametti Circle 5'-6' to the north. <br /> <br />5. IS' sideyard setback from the south pro'perty lines of <br />Lots 3 and 4, Block 2 (a covenant restriction on these <br />2 lots). <br /> <br />Motion carried unanimously. (4-0) <br /> <br />Council listed the following as important concerns to be addressed <br />in the covenants: <br /> <br />1. Boat Launching- It was noted ~hat opposition to a boat <br />launcp was expressed; precedent has been <br />set to some extent (1 existing association <br />permits boat launching, 1 existing <br />association does not); both now have minimal <br />us age. <br /> <br />2. Maintenance of the common area. <br /> <br />3. <br /> <br />Dockage- including number and size of structure(s) . <br />(2 shorter docks may be preferable to 1 long dock) <br /> <br />4. No over-night dockage of power boats or parking of boats <br />andlor trailers in the common area. <br /> <br />5. Fencing of the common area. <br /> <br />6. Structures in the common area (covered picnic structures, <br />playground equipment, etc.) <br /> <br />7. Swimming area restrictions, if any. <br /> <br />8. Fishing from dock limitations, if any. <br /> <br />9. Architectual restrictions on homes in the development, <br />as well as height, quality and size restrictions. <br />
