<br />I <br />I 4. The subject structure was extensively damaged by fire and is currently manifestly unsafe; <br />,. 5. The subject structure has damage or deterioration in excess of 33 percent of its supporting <br /> members; <br /> 6. The subject structure has damage or deterioration in excess of 50 percent of its <br /> nonsupporting members, enclosing or outside walls or coverings; <br />I 7. The damage or deterioration of the subject structure relates to its strength, fire-resistance <br /> qualities or characteristics, and weather-resisting qualities or characteristics; <br /> 8. The subject structure was damaged in excess of 75 percent of its value; <br />I 9. The subject structure has been abandoned for a period in excess of six months; <br /> 10. Therefore, the subject structure is a Dangerous Building as defined by Section 302 of the <br /> Uniform Code For The Abatement Of Dangerous Buildings as incorporated into the City <br />I Code in Section 6-18; <br /> 11. The subject structure injures or endangers the comfort, repose, health, or safety of others; <br /> 12. The subject structure is offensive to the senses; <br />I 13. The subject structure essentially interferes with the comfortable enjoyment of life and <br /> property, or tends to depreciate the value of the property of others; <br /> 14. The subject structure is in such a dilapidated condition that it is unfit for human <br />I habitation; <br /> 15. The subject structure has not been "completed" for a continuous period of two years; and <br />I 16. Therefore, the subject structure is a nuisance as defined by Chapter 16 of the City Code. <br /> Budget Impact <br />.. The budget for fiscal year 1996 or 1997 does not identify the expenditure of funds for the <br /> acquisition of the subject property. However, it is anticipated that at the end of calendar year <br /> 1996 there will exist a sufficient balance in the general fund to finance either option. The Staff <br />I would suggest that the acquisition or condemnation of the subject property may be an appropriate <br /> use of a small portion of that fund balancc. <br />I Recommendation <br /> The Staffrccommends that thc City Council adopt Resolution #96-59, authorizing the City <br /> Administrator to extcnd an offer to purchasc 1900 Edgewater A venuc for an amount not to <br />I excecd $17,300.00. If the offer is not acccptcd by the property owncr within ten (l0) days of <br /> receipt of thc offer, then the City Attorney is authorized to proceed with the condemnation of the <br />I building on 1900 Edgewater A vcnue. <br />I <br />I <br />I <br />i' <br />I <br />
