<br /> Contract No. '1 <br /> INFLOW/INFILTRATION CONTROL PROGRAM I <br /> GRANT AGREEMENT BETWEEN THE METROPOLITAN COUNCIL -I <br /> AND <br /> CITY OF ARDEN HILLS <br /> THIS AGREEMENT is entered into by and between the Metropolitan Council (the I <br /> "Council") and City of Arden Hills (the "Grantee"), each acting by and through its duly <br /> authorized officers. I <br /> WHEREAS,it is in the best interests of the Metropolitan Council and a benefit to the <br /> metropolitan area to reduce excess inflow and inftltration ("III") into local sewer I <br /> systems, which discharge into the Metropolitan Disposal System, in order to reduce costs, <br /> increase system capacity, and delay the necessity to undertake capital improvements; and <br /> I <br /> WHEREAS,the Metropolitan Council has allocated funds to be used for grants to <br /> communities serviced by the Metropolitan Disposal System in order to fund studies I <br /> aimed at identifying, locating, quantifying and developing action plans for the elimination <br /> of excessive community inflow and infiltration into the local sewer systems; and I <br /> WHEREAS,it is in the best interests of the Grantee to reduce inflow and infIltration <br /> into its local sewer system in order to increase capacity, reduce costs, and delay the .. <br /> necessity to undertake capital improvements; and <br /> WHEREAS, the Grantee is eligible to receive an Inflow/InfIltration Control Program I <br /> Grant and has submitted an application for a such a grant; and <br /> WHEREAS, the Council has reviewed the application and desires to assist the Grantee I <br /> by the award of an Inflow/InfIltration Control Program Grant. <br /> NOW, THEREFORE, the Council and the Grantee agree as follows: I <br /> I. GRANTEE PERFORMANCE OF GRANT STUDY <br /> 1.01 Grant Study Activities. The Grantee agrees to perform and complete in a I <br /> satisfactory and proper manner the study as described in the Grantee's application for <br /> grant assistance ("Grant Study"), incorporated in this agreement by reference, and in I <br /> accordance with the terms and conditions of this agreement. Specifically, the Grantee <br /> agrees to perform the study activities described in Exhibit A, which is attached to and <br /> incorporated in this agreement. After the Work Plan described in paragraph 5.01 has I <br /> been approved by the Council, the Grantee agrees to conduct the Grant Study activities <br /> in compliance with the approved Work Plan. The Grantee may engage contractors to <br /> perform the Grant Study with prior approval of the Council. However, the Grantee I <br /> retains primary responsibility to the Council for performance of the Grant Study. <br /> .. <br /> I <br />
