The applicant has also reconfigured the <br /> building such that less of the wall is penetrating into the setback area. Lastly, the applicant has <br /> improved the sight lines from the adjacent home (Lynch @ 3220 North Hamline Avenue). I <br /> The reconfigured garage location provides for a 15 foot front yard setback. The garage was <br /> reconfigured such that it is located onto the applicants driveway, The applicants driveway, in I <br /> this area, is 20 feet in width. The driveway will need to be narrowed to approximately 12 feet in <br /> width to accommodate the reconfigured garage location and associated turn movements. The <br /> garage setback could be minimized even further if the driveway was relocated further east. I <br /> However, there exists a five foot diameter tree which would have to be removed to accommodate <br /> the driveway relocation. <br /> The garage was also reeonfigured such that the penetration into the setback area was minimized I <br /> by rotating the garage parallel with the Lynch's side yard. The rotated garage will minimize the <br /> visual impact of the strueture from North Hamline Avenue. The City Council may wish to I <br /> require landscaping to further "soften" the view of the garage from North Hamline Avenue. The <br /> Lynch's had previously raised concerns with the applicant and Staff that the location of the I <br /> garage not restrict their view up North Hamline A venue as they back out of their driveway. The <br /> garage location as reconfigured improves the Lynch's view up North Hamline Avenue from their <br /> driveway. ., <br /> The City Council may wish to take into account the unusually shaped and dimensioned right-of- <br /> way of North Hamline Avenue. The width of the right-of-way for North Hamline Avenue is I <br /> typically 33 feet, when most residential streets are 30 feet. The width of the right-of-way across <br /> the Danielson property varies from 33 feet to 48 feet. Given, that the public traversing <br /> residential streets typieally would comprehend excessive right's-of-way as private property, I <br /> rather than as a right-of-way. The public should "perceive" the garage to have a setback of22 <br /> feet, rather than a setback of 15 feet (Exhibit B). <br /> Lastly, if the City Council chooses to approve the variances, then the Staff would recommend the I <br /> following as minimum conditions of approval: provision of landscaping adjacent to the North <br /> Hamline Avenue sides of the garage to be approved by staff; landscaping to be installed with the I <br /> construction of the garage; the garage shall not have a direct aceess to North Hamline Avenue; <br /> and the garage shall be eonstructed as shown in Exhibit A. I <br /> Deadline for A~encv Actions <br /> The City of Arden Hills received the complete application for this request on August 29, 1996. I <br /> Pursuant to Minnesota State Statute the City must act on this request by Monday, Oetober 28, <br /> 1996 (60 days), unless the City provides the petitioner with written reasons for an additional 60 <br /> day review period. The additional review period would extend to Friday, December 27,1996. I <br /> The City may with the petitioners consent extend the review period beyond the Friday, <br /> December 27,1996 date. Lastly, if the City denies the petitioners request, "... it must state in .. <br /> writing the reasons for the denial at the time that it denies the request." <br /> I <br />
