SUBJECT: Planning Case 95-23 <br /> The following is a brief review of the request and the recommendation of the Planning <br />I Commission. <br /> Casc 95-23. Bart Buetow. 1433 Forest Lane. Preliminary RLS <br />. A. ~cquest . <br />. he applicant is requesting approval of a preliminary Registered Land Survey (RLS) <br /> consisting of three tracts on a 1.11 acre parcel zoned R-I Single Family Residential <br /> District (Exhibit A). <br />I. I <br /> B. Baekl!round <br /> The property under consideration in this request consists of three (3) existing lots (Lots <br />. 16, 17, and 18 of Arden Hills No.2). The property also contains an existing home (1433 <br /> Forest Lane), which is located on Tract A on the preliminary RLS and on Lot 16 and a <br /> portion of 17 on the existing plat. <br />I The Planning Commission has received during its review of this request considerable <br /> discussion and conccrn from the neighborhood regarding the compatibility of the request <br />. with thc adjacent neighborhood. In general, the neighborhoods concerns were that the <br /> preliminary RLS; provided for lots which were out of context with the neighborhood by <br />I bcing smaller than average, unnecessarily removed existing mature hardwood trees, and <br /> had the potential to cause adverse drainage onto adjacent properties. The City Code in <br /> Chapter 22 (the Subdivision Ordinance) outlines the rules and regulations for the <br />I development of subdivisions. The Subdivision Ordinance in its text does not refer to <br /> compatibility as an item for review. However, the Subdivision Ordinance in Section 22- <br /> 12, (e), (3) does state: "It is detcrmined that the proposed division or consolidation will <br />I not be detrimental to the public wclfare or injurious to adjacent tracts in the area in which <br /> the subdivision tract is located". <br />I C. Planning Commission Rccommendation <br /> The Planning Commission recommends approval of Planning Case 95-23, preliminary <br />.- RLS, subject to the following conditions: <br />. <br />
