<br />" ... <br />I <br />I CITY OF ARDEN HILLS <br />I- MEMORANDUM <br /> DATE: June 24, 1996 <br />I TO: Mayor and City Council <br />I FROM: Kcvin Ringwald, Community Development Director ~ <br /> SUBJECT: Case #95-1, Site Plan extension <br />I One Comm, 1230 Red Fox Road <br />I Request <br /> The applicant is requesting an extension of their site plan approval to December 31, 1996 so as to <br /> accommodate their anticipated construction of transmission towers at the Red Fox Road water <br />I tower (Exhibit A). <br /> Discnssion <br />I The applicant received special use permit and site plan approval from the City Council at its <br /> regular meeting of January 30, 1995 in Planning Case 95-01. The City Council previously <br /> extended this site plan approval in December of 1995 for six months. <br />.. The Zoning Ordinance in Section VIII, F, 2, states in relevant part, "Approval shall automatically <br /> expire and become void one (1) year from and after the date on which the council granted such <br />I approval if the building permit or other approved improvements have not been issued a permit by <br /> the building inspector. The council may extend the expiration date of such approval upon written <br />I application by the person to whom the approval was granted". Therefore, the City Council <br /> approval of Planning Case 95-01 expires on June 30,1996, <br />I The applicant has offered to commence payment of the rent on July I, 1996. The rent as <br /> provided by the lease is $862.00 per month for the first five years. <br />I Recommendation <br /> The Staff recommends that the approval of Planning Case 95-01 be extended until June 30,1996, <br /> subj ect to the original conditions of approval, and payment of the rent commencing on July 1, <br />I 1996. <br />I <br />I <br />,. <br />I <br />
