<br />I' ... <br />I CITY OF ARDEN HILLS <br />I- MEMORANDUM <br /> DATE: June 24, 1996 <br />I TO: Mayor ~nd City Council <br />I FROM: Kevin Ringwald, Community Development Director W- <br /> SUBJECT: Planning Cases 96-06, 96-07, and 96-10 <br />1 The following is a brief review of the requests and the recommendations of the Planning <br />I Commission. <br /> Case 96-06. Herb Tousley. 3248 Sandeen Road. Front and Side Yard Variance <br />I 1. Request <br /> The applicant is requesting approval of a variance from the required front and side yard <br />I setbacks. The front yard setback being requested is 35 feet, when 40 feet is required. <br /> The side yard setback being requested varies from approximately 2.7 feet to 4 feet, when <br /> 5 feet is required (Exhibit A). <br />.. 2. Background <br />I The property at 3248 Sandeen Road is located within the R-2 Single and Two Family <br /> Residential District. The property currently contains an existing single family structure. <br /> The property is located within the shoreland management zone of Lake Johanna. <br />I Therefore, the property is subject to the Shoreland Management regulations (Chapter <br /> 20.5) of the City Code. The applicant is requesting the front yard variance so that the <br /> front yard of this property would have a similar building setback from Sandeen Road as <br />I the adjacent properties. The applicant is requesting the side yard variance due to the fact <br /> that the existing structure is currently that distance from the side property line. <br />I 3. Planning Commission Recommendation <br /> The Planning Commission recommends approval of Planning Case #96-06, front and side <br /> yard variances, subject to the following conditions: <br />I 1. If the building is damaged or destroyed by any cause in excess of fifty percent <br /> (50%) of the fair market value of said building, as determined by the building <br />I inspector, then the side yard (north property line) setback variance as explicitly <br /> shown on Exhibit A, page 1 of3 of this memorandum would become null and <br />I void, and <br /> 2. City Council consideration of the proposed site plan, including the exterior <br />it elevations of the proposed addition (Exhibit B). <br />I <br />
