<br /> .... .. <br /> . <br /> CITY OF ARDEN HILLS <br /> I MEMORANDUM <br /> it DATE: October 28,1996 <br /> I TO: Mayor and City Council <br /> Brian Fritsinger, City Administrator W <br /> FROM: <br /> I SUBJECT: Resolution #96-61, Vacating a Sanitary Sewer Easement <br /> I Introduction <br /> The applicant (Welsh Companies) requests that the City Council adopt Resolution 96-61 which <br /> I vacates a portion of a 30 foot wide sanitary sewer easement on property in the Gateway Business <br /> District (GBD) which is to be developed, per Planning Case 96,12 (Exhibit A). <br /> I BackHound <br /> The City Council on September 30, 1996 approved the development proposed by the Welsh <br /> Companies on a parcel in the GBD (Exhibit B). The approval granted by the Council included <br /> I the vacation of the subject sanitary sewer easement. The adoption of Resolution #96-61 would <br /> formalize the sanitary sewer easement vacation previously approved by the City CounciL <br /> Ie The City Engineer has reviewed the vacation and made the City aware of two issues included in <br /> the easement agreement. Page 3 of Exhibit D states that the City will be responsible for all <br /> remaining sanitary sewer, not actually vacated and that the Grantor shall construct a manhole <br /> I over the southerly end of the remaining easement. As a result of this, the vacation should be <br /> conditioned upon the developer (Welsh Companies) constructing a new manhole at the end of the <br /> I remaining sanitary sewer line. <br /> Recommendation <br /> I The Staff recommends adoption of Resolution #96-61, <br /> I <br /> I <br /> I <br /> I <br /> .. <br /> I <br />
