CITY OF ARDEN HILLS <br /> I MEMORANDUM <br /> I DATE: November 25,1996 <br /> TO: Mayor and City Council <br /> I FROM: Kevin Ringwald, Community Development Director ~ <br /> I <br /> SUBJECT: Planning Case 96-17, Master Plan and Final Plan <br /> Saint Paul Companies, Lexington Avenue and Grey Fox Road <br /> I Reouest <br /> The applicant is requesting approval of a Planned Unit Development (PUD) Master Plan (Saint <br /> I Paul Properties) and Final Plan (Arby's/Sbarro) to facilitate the construction ofa 4,137 square <br /> foot fast food restaurant (Arby's/Sbarro) on an approximately five acre parcel zoned B-3 (Exhibit <br /> A). <br /> I Backe-round <br /> The two primary issues that were discussed at the Planning Commission meeting was the waiver <br /> .. of the 1320 foot distance requirement between fast food uses and the traffic impact of the <br /> proposed development. <br /> I The applicant is proposing two principal uses for the property, a fast food use and a retail use. <br /> Fast food uses not only need to meet the criteria for a Special Use Permit (SUP) as found in the <br /> I Zoning Ordinance, Section VII, but also meet additional criteria for Fast Food restaurants as <br /> found in the Zoning Ordinance, Section VI, D, and Fast Food restaurants in the B-3 zoning <br /> district as found in the Zoning Ordinance, Section V, H. <br /> I The fast food use (Arby's/Sbarro) is approximately 700 feet from the Burger King (another fast <br /> food use) at 3751 Lexington Avenue. The Zoning Ordinance in Section VI, D, I, b, requires that <br /> I fast food restaurants be at least 1,320 feet apart. The Zoning Ordinance in Section V, H, 4, states <br /> that the distance requirement "may be waived" if certain conditions are met. Those conditions <br /> are: <br /> I I. The operation consists of one or more drive-in businesses or fast food restaurants and is <br /> an integral part of a building containing one or more other allowed uses, or the operation <br /> I is part of an architecturally unified "food court" or "drive-in service court" complex <br /> containing two or more restaurants, fast food restaurants or drive-in businesses; <br /> 2. Shared access drives and shared parking are utilized by all such restaurants, fast food <br /> I restaurants or drive-in businesses in said building or complex; <br /> ~ <br /> I <br />
