Walsh, Parks and Recreation Director l0~ <br /> SUBJECT: Barry O'Meara Outlotrrrail Access Land Transfer <br /> I Backā¬Tound <br /> I The residents of the Katie Lane/Katie Court neighborhood sent the City a copy of the petition to <br /> Mr. O'Meara asking that he pave the access from their neighborhood to the Hazelnut trail. Mr. <br /> O'Meara responded by indicating that he had given that parcel of property to the City. <br /> I However, the plat map and tax roles indicated that Mr. O'Meara had fee title to the parcel, which <br /> was identified as Outlot A rather than a trail access. <br /> I Attorney Filla contacted Mr. O'Meara to inquire whether he would be willing to transfer the <br /> property to the City for the purpose of a trail easement. Mr. 0' Meara indicated that he would be <br /> willing to convey this property to the city by Quit Claim Deed but that he is unwilling to pay for <br /> . any costs associated with the conveyance or with the payment of any delinquent taxes. At that <br /> time, Attorney Filla estimated that the delinquent taxes and recording fees would be <br /> approximately $300. <br /> I While the Council had some hesitation regarding the fees associated with transfering the parcel <br /> I from 0' Meara, there seemed to be a willingness to accept the Outlot for trail access purposes. <br /> The Parks and Recreation Commitee has reviewed the request from the residents to accept this <br /> trail access into our trail system. They passed a motion to recommend to the City Council that <br /> I the Quit Claim Deed be accepted from Mr. O'Meara, and the parcel be incorporated into the <br /> City's trail system. They feel it was appropriate to make any recommendation to pave the <br /> access. They intend to discuss the condition of the access with the residents in January along <br /> I with other trail access issues. <br /> Possible Park Dedication Requirement <br /> I There has been some discussion about this parcel being part of a previous park dedication <br /> requirement from Mr. O'Meara for the Hazelnut Park Subdivision or a retail development. I can <br /> not find any record that this parcel is part of a park dedication requirement. Our records indicate <br /> I that Mr. O'Meara has satisfied all of his park dedication requirements without dedicating this <br /> trail access to the City. <br /> I <br /> ~ <br /> I <br />
