Persons operating a motorboat, and those being towed on water skis or a <br /> similar device shall, at all times, maintain an adequate distance (considering <br /> speed and conditions) from other watercraft, swimmers, swim rafts and <br /> docks, so as to avoid an accident. When a swimmer is present, motorboats <br /> or persons being towed on water skis or a similar device, shall not pass <br /> between a swim raft and the nearest shore. <br /> Exemptions. Parties which would be exempt from complying with the terms <br /> of the Ordinance: <br /> a. Authorized resource management emergency and enforcement <br /> personnel, when acting in the performance of their duties, shall be <br /> exempt from the provisions of this ordinance. <br /> b. A temporary exemption from these restrictions for a special event <br /> may be granted upon approval by tlle City Councils and the issuance <br /> of a permit by the Ramsey County Sheriff's Department. <br /> B. Each City shall be responsible for informing the public, posting notification at all <br /> public accesses and marking or buoying areas affected by the ordinance as necessary <br /> to give reasonable notice of the restrictions of the ordinance. <br /> . <br /> C. Each City shall advise the owners of properties surrounding Lake Josephine who <br /> reside in the respective City that motorboat speed and use regulations have been <br /> adopted. <br /> D. Each City shall request the appropriate law enforcement agency to enforce the <br /> provisions of such ordinance and will notify the other party when such request is <br /> made. <br /> E. Neither City shall change or amend its ordinance relating to motorboat regulations <br /> and speed limits on Lake Josephine without consultation with the other. <br /> . <br /> 4 <br />
