<br /> <br /> <br /> <br /> <br /> CITY OF ARDEN HILLS <br /> COUNTY OF RAMSEY <br /> STATE OF MINNESOTA <br /> <br /> ORDINANCE NO. 308 <br /> <br /> <br /> AN ORDINANCE AMENDING CHAPTER 3 OF <br /> THE CITY OF ARDEN HILLS MUNICIPAL CODE <br /> RELATING TO THE SALE OF STRONG BEER <br /> <br /> <br /> The Arden Hills City Council hereby ordains that the following language is added to Chapter 3, <br /> Section 3-38(c) of the Arden Hills City Code is amended to read: <br /> <br /> <br /> Section 3-38. Classification. <br /> <br /> <br /> (c) "On-sale wine" licenses shall be issued only to restaurants meeting the <br /> qualifications of Section 340.11, Subdivision 20 of Minnesota Statutes Annotated, <br /> as amended, and shall permit only the sale of wine not exceeding fourteen (14) <br /> percent alcohol by volume, for consumption on the licensed premises only in <br /> conjunction with the sale of food; provided, however, that in no event shall such <br /> "on-sale wine" licenses be issued to "fast-food restaurants" as that term is defined <br /> in Section VI, Subdivision 6 of Ordinance No. 99, as amended by Ordinance No. <br /> 188. All references in this chapter to "on-sale" licenses or sales shall be deemed <br /> to include "on-sale wine" licenses or sales unless the context in which the term is <br /> used clearly requires a different interpretation. <br /> <br /> "The holder of an on-sale wine license who is also licensed to sell non- <br /> intoxicating liquor/malt beverages "on-sale" and whose gross receipts are at least <br /> 60% attributable to the sale of food may also sell intoxicating malt liquors "on- <br /> sale" without an additional license." <br /> <br /> <br /> Effective Date <br /> This ordinance shall become effective the day following its publication in the City's official <br /> newspaper. <br />
