CITY OF ARDEN HILLS <br /> COUNTY OF RAMSEY <br /> STATE OF MINNESOTA <br /> ORDINANCE NO.308 <br /> AN ORDINANCE AMENDING CHAPTER 3 <br /> OF THE CITY OF ARDEN HILLS <br /> MUNICIPAL CODE RELATING TO THE <br /> SALE OF STRONG BEER <br /> The Arden Hills City Council hereby ordains <br /> that the following language is added to <br /> Chapter 3, Section 3-38(c) of the Arden Hills <br /> City Code is amended to read: <br /> section 3J8.Clsealflcatlon. <br /> (c) "On-sale wine' licenses shall be issued <br /> only to restaurants meeting the qualifications <br /> of Section 340.11, Subdivision 20 of <br /> Minnesota Statutes Annotated, as amended, <br /> and shall permit only the sale of wine not <br /> exceeding fourteen (14) percent alcohol by <br /> volume, for consumption on the licensed <br /> premises only in conjunction with the sale of <br /> food;provided,however•that in no event shall <br /> such "on-sale wine- licenses be issued to <br /> "fast-food restaurants'as that term is defined <br /> in Section VI, Subdivision 6 of Ordinance No. <br /> 99, as amended by Ordinance No, 189. All <br /> references in this chapter to'on-sale" censes <br /> li <br /> or sales shall be deemed to induda 'on-sale <br /> wine" licenses or sales unless the context in <br /> which the term is used clearly requires a <br /> different interpretation. <br /> "The holder of an on-sale wine license <br /> who is also licensed to sell non-intoxicating <br /> liquor/malt beverages 'on-sale' and whose <br /> gross receipts are at least 60%attributable to <br /> the sale of food may also sell intoxicating malt <br /> liquor%-on-sale'without an additional license- <br /> F_ffecilve Date <br /> This ordinance shall become effective the <br /> day following its publication in the City's <br /> official newspaper. <br /> Adontlon Date <br /> Passed by the City Council of the City Of <br /> Arden Hills this 29th day June, 1998. <br /> /e/Dennie Probst <br /> .
