<br />. Subscribers who receive all or any part of the total services offered on the <br /> System shall be eligible to receive such channels at no additional charge. <br /> The channel(s) shall be activated upon the effective date of this Franchise <br /> and thereafter maintained. City may rename, reprogram, or otl1erwise <br /> change the use of these channels in its sole discretion, provided such use <br /> is non-commercial, lawful, and retains the general purpose of the provision <br /> of community programming. Nothing herein shall diminish the City's <br /> rights to secure additional channels pursuant to Minn. Stat. !l 238.084, <br /> which is expressly incorporated herein by reference. City shall provide <br /> ninety (90) days prior written notice to Grantee of City's intent to activate <br /> access channels. <br /> c. Each public and government access channel(s) required by this Section <br /> shall retain the channel designation/number it had as of the commencement <br /> of this Franchise term. Grantee may not move or otherwise change tl1e <br /> channel number or location of any public or government access or <br /> community program channel witl10ut tl1e written approval of the City or its <br /> designee. Upon six (6) months notice to City, any other access channel <br /> may be moved by Grantee, but in no event more than once every two (2) <br /> years unless otherwise allowed by City, provided Grantee pays all <br /> reasonable costs or expenses arising out of tl1e channel move including, but <br />t not limited to, equipment necessary to effect the change at tl1e <br /> programmer's production or receiving facility (school frequency routing <br /> equipment, etc.), signage, letterhead, business cards, and reasonable <br /> marketing or other constituency notification costs. In any event, those <br /> access channels carried on tl1e universal service tier pursuant to the MOD <br /> shall remain on the universal service tier. This paragraph shall not apply <br /> to Regional Channel 6. <br /> 2. Char~es for Use. Channel tinle and playback of prerecorded programming on tl1e <br /> PEG access and community program channe1(s) must be provided without charge <br /> to City and the public. <br /> 3. Access Rules. City, or its designee, shall implement rules for use of any access <br /> channel(s). <br /> 4. Access SUDDort. Grantee shall continue to be obligated pursuant to the MOU, and <br /> shall additionally provide $667,286.00 over the term of this Franchise for tl1e <br /> acquisition of new equipment according to the schedule in Exhibit A attached. <br /> 5. Studio Relocation. In addition to the agreement between the City and Grantee <br /> regarding tl1e Nortl1 Suburbs Access Corporation relocation pursuant to the access <br /> transfer agreement, the following shall apply: If N ortl1 Suburbs Access <br />. Corporation expends, with Grantee's express written consent which may not be <br /> unreasonably withheld, over $1,000.00 to remodel or renovate its leasehold in a <br /> 17 <br />
