CONSENT ITEM - 8K <br />­i`i II�)EN_ HILLS <br />MEMORANDUM <br />DATE: December 8, 2025 <br />TO: Honorable Mayor and City Councilmembers <br />Jessica Jagoe, City Administrator <br />FROM: Elena Fransen, AICP, Senior Planner <br />SUBJECT: Planning Case 24-018 — Trident Development — 1700 Highway 96 W — Extension <br />Request <br />Budgeted Amount: <br />N/A <br />Council Should Consider <br />Actual Amount: <br />N/A <br />Motion to approve, table, or deny the following: <br />Funding Source: <br />N/A <br />• A 6-month extension to July 13, 2026, to apply for construction permits for a multi -family <br />dwelling, following approval of Planning Case 24-018 — Planned Unit Development and <br />Conditional Use Permit. <br />Background <br />The City Council approved a Master and Final Panned Unit Development, Final Plat, Site Plan <br />Review, Conditional Use Permit and Easement Vacation for Trident Development ("Developer") at <br />1700 Highway 96 W at the January 13, 2025, regular City Council meeting. The approval included <br />33 conditions. The project subdivides the property into two conforming lots to construct a 162,819 <br />square foot, 119-unit multiple -family dwelling on an approximately 41-acre property and construct <br />additional parking for the existing house of worship. The Developer intends to purchase the subject <br />property from North Heights Church. <br />On April 28, 2025, the City Council reviewed a request to modify language in the Conditions of <br />Approval in Resolution 2025-007 to allow for the Developer to make a financial contribution toward <br />the cost of the trail in place of bearing the total expense of the 1,373-foot trail as referenced in <br />Condition 28. The Developer also requested updated language to Condition 29, which references a <br />396-foot trail segment associated with the Development. The City Council tabled this item for review <br />at the next Council meeting and approved Resolution 2025-040 and proposed language to modify <br />Resolution 2025-007 on May 12, 2025, regular City Council meeting. <br />On May 27, 2025, the City Council approved the Development Agreement (Attachment B). <br />Page 1 of 2 <br />
