<br /> <br /> <br /> <br /> <br /> STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> CITY OF ARDEN HILLS <br /> <br /> ORDINANCE N0. 287 <br /> AN ORDINANCE IMPOSING A RESIDENTIAL RECYCLING FEE. <br /> <br /> The Arden Hills City Council hereby ordains that Article IV, <br /> Sections 11-30 to 11-35 are hereby added to Chapter 11 of the Arden <br /> Hiils City Code to read as follows: <br /> <br /> IV. Residential Recycling Service Fee. <br /> 11-30. Purpose and Intent. Consistent with the policies expressed <br /> in the Minnesota Waste Management Act (MS 115A), the City of Arden <br /> Hills has implemented a curbside recycling program for all <br /> residential dwelling units within the City. Although other sources <br /> of funding will be used when available, the City Council has <br /> determined that the economic viability of the City's residential <br /> curbside recycling program and the ultimate benefits resulting <br /> therefrom require the imposition of a residential recycling service <br /> fee. <br /> 11-31. Imposition of Fee. Except as herein provided, a <br /> residential recycling service fee is hereby imposed on the owners <br /> of all residentially occupied property within the City. The owners <br /> of multiple family dwellings and the owner of the manufactured home <br /> park may be exempt from such fee upon furnishing proof, in a manner <br /> satisfactory to the City Administrator, that such owners have <br /> contracted for the collection of recyclable materials by a <br /> collector other than the City designated collector. Proof of such <br /> alternate service shall be submitted no later than July 15, 1992, <br /> and shall indicate that a contract has been entered into for the <br /> succeeding calendar year. The total number of residential dwelling <br /> units less the total number of exempt residential dwelling units, <br /> shall hereinafter be referred to as the total number of assessable <br /> - residential dwelling units. <br /> 11-32. Computation of Fee. Before August 31, 1992, the City <br /> Administrator shall determine the succeeding years estimated budget <br /> for the collection of recyclable materials for residential <br /> dwellings and the total number of assessable residential dwelling <br /> units within the City. The proposed residential recycling service <br /> fee for each assessable residential dwelling unit shall not exceed <br /> an amount equal to the unfunded portion of the estimated recycling <br /> budget divided by the total number of assessable residential <br /> dwelling units within the City. Unless otherwise exempted, owners <br /> of multiple family dwellings shall be charged a recycling fee for <br /> each dwelling unit within a multiple family structure. Unless <br /> otherwise exempted, the owner of the manufactured home park shall <br /> be charged a recycling fee for each lot within the manufactured <br /> home park. _ <br /> 1 <br />
