<br /> <br /> <br /> <br /> <br /> <br /> STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> CITY OF ARDEN HZLLS <br /> ORDINANCE NO. 286 <br /> <br /> <br /> AN ORDINANCE RELATING TO THE SCAVENGING OF RECYCLABLE <br /> MATERIALS. <br /> The Arden Hills City Council hereby ordains that Article III, <br /> Sections 11-22 to 11-25 and their subdivisions are hereby added to <br /> the Arden Hills City Code to read as follows: <br /> <br /> III. Unauthorized Collection of Recyclable Materials. <br /> 11-22. Purpose. The City of Arden Hi11s has contracted with a <br /> service provider for the collection of recyclable materials and has <br /> otherwise implemented a recycling program within the City. The <br /> City's ability to maintain favorable contracts depends, in part, <br /> upon the volume of recyclable materials which are placed on <br /> curbside by Arden Hills residents. The unauthorized collection or <br /> "scaven.ging" of recyclable materials wi11 reduce the volume <br /> available for collection as part of the designated recycling <br /> program. Scavenging also causes confusion among participating <br /> residents and thereby disrupts the publicity and educational <br /> processes of an authorized program. The purpose of this article is <br /> to ensure that a designated recycling program will be implemented <br /> in an orderly fashion to avoid adverse effects on the public <br /> health, welfare, safety and enviranment. <br /> 11-23. Definitions. <br /> (a) "Authorized or Designated Recycling Program" shall mean a <br /> program for the collection and recycling of the recyclable <br /> materials which is instituted, sponsored and/or approved by <br /> the City of Arden Hills. <br /> (b) "Recyclable Materials" shall mean items of refuse which are <br /> part of an authorized recycling program of which are intended <br /> for transportation, processing, and manufac-turing or re-use, <br /> including but not limited to, paper, glass, aluminum, and <br /> other metal cans and cantainers. <br /> (c) "Scavenging" shall mean the unauthorized collection of <br /> recyclable materials that have been set out by residents of <br /> the City specifically for collection as part of an authorized <br /> or designated recycling program. <br /> <br /> 11-24. Ownership. Ownership of recyclable materials set out for <br /> the purpose of participating in a curbside recycling program shall <br /> remain in the person or household from which the materials <br /> originated until- collected by an authorized collector.
